I didn't read ALL of the posts, so this may be a repeat but didn't this same kinda situation happen with Michael Mitchell from highlands....

Couldn't agree more about the "closer to God" bull. Two of my sons were in on a tackle against NCC last year and the would-be ball carrier was yelling "Get off me, you EXPLETIVE DELETED HOMOPHOBIC SLUR DELETED!" My older son was amused, his younger brother shocked, telling me after the game "But that's a CATHOLIC school!" Sometimes, education don't cost a dime.

At this time that informed decision appears to be negative ghost-rider.

Then using your logic the KHSAA did make an informed decision taking into all account all the "facts" and ruled against the waiver.

 

Everything I am gathering is pointing towards an appeal soon where it is possible that the Floyd's make a more compelling case which may/could/may not result in the KHSAA reversing their decision.

 

The appeal would have to be extremely compelling and contain some new information not presented in the past. I just don't see how they are going to get over the not for athletics hurdle.

Nope, there's that whole speedy due process thingy. Plus, the KHSAA is now at the mercy of the court when an injection is filed.

Injunction till Dec or try to play at Boone?

Locally injunctions have been heard in court within a week after filing.

FF18 there are about 20 or so kids here at the local school, and I suspect every other school, who really 'deserve' all that CovCath has to offer. Maybe you could take on some of those folks and try that 'transformation' thingy that you all do.

The KHSAA has old meeting notes on its website from meetings in the 60s, 70s etc. If you read some of them the Parents and the Student either had to send a letter to the KHSAA or appear in person and state their case in order to eligible for athletics. Sometimes they were declared eligible and sometimes they were not.

Never implied he did. Just illustrating that attending a Catholic high school does not make you any "closer to God" as previous poster implied. Especially those pesky "scholarship" kids, eh???

Before Floyd could take the matter to court, he has to exhaust his administrative remedies. Which means he has to get a final decision from the KHSAA. Which means he has to appeal the initial determination; have a hearing in front of the KHSAA hearing officer; whom then makes a recommendation to the Commissioner; whom then considers the recommendation and makes the final ruling on behalf of the KHSAA. Which would, in normal circumstances, take 30 to 45 days (perhaps more) from the date the appeal with the KHSAA is filed. When the KHSAA makes its final ruling, then Floyd could avail himself to the judicial system under the Ky Constitution and Chapter 13B of the Kentucky Revised Statutes. I'd be very surprised if a judge would even consider issuing an injunction until the KHSAA process is completed and if he/she did, I think the KHSAA could quickly get it overturned.

 

PS: Circuit Court, not District Court, hears appeals of state agency decisions.

Sounds to me like hes not playing at Covcath.
