Aaron Floyd's Waiver Denied

Featured Replies

Before Floyd could take the matter to court, he has to exhaust his administrative remedies. Which means he has to get a final decision from the KHSAA. Which means he has to appeal the initial determination; have a hearing in front of the KHSAA hearing officer; whom then makes a recommendation to the Commissioner; whom then considers the recommendation and makes the final ruling on behalf of the KHSAA. Which would, in normal circumstances, take 30 to 45 days (perhaps more) from the date the appeal with the KHSAA is filed. When the KHSAA makes its final ruling, then Floyd could avail himself to the judicial system under the Ky Constitution and Chapter 13B of the Kentucky Revised Statutes. I'd be very surprised if a judge would even consider issuing an injunction until the KHSAA process is completed and if he/she did, I think the KHSAA could quickly get it overturned.

PS: Circuit Court, not District Court, hears appeals of state agency decisions.

Thanks for the details lneck.

District Court.

On the court, Circuit Court per leatherneck's post. We are talking a Boone County family, a Kenton County Court, and a private school. I know most people get friendly Judge decisions but I just don't see a Judge granting the injunction. I think the Judge will get blown up on appeal and like everyone else Judge's don't like to look bad.

On top of that CovCath would run the risk of having to forfeit games.

You do understand how recruiting works as far as it goes with 99.9% of the football players don't you? What happens on friday nights (or in CCH's case, Sat Afternoons) equates to about .09% of recruiting. Games will not get him recruited as much as camps, films etc. So again CCH offers nothing he can't get at Boone, actually Boone would showcase him even more if he is actually that much better than the rest of his teammates.

Again your reasoning is actually what is laughable. "He deserves to go to CCH because it's his high school years" What does that even mean? The education isn't even as good as the school right down the street at Beechwood so please enough with the education aspect of it. (Just so you know Beechwood is ranked 4th in the entire state)

That's a pretty bold claim. Hellbird, "just so you know Beechwood is ranked 4th in the entire state" when it comes to the KPREP End-of-Course test scores. Pretty ridiculous to say the education offered at Cov Cath "isn't even as good as the school right down the street at Beechwood" if you're going to base your claim off of tests that private schools don't even take. :thumb:

If you're CovCath, do you take a chance on allowing the young man to play via an injunction? More importantly, my view of CovCath is that their athletics is above reproach. If they take him with the injunction, does it change your image of CovCath?

The only talk of using the courts has been here, I have heard no one at CovCath say anything about going to court to get Floyd to play. And I can not believe Bob Rowe would permit anyone to play who has not been cleared by the KHSAA

It would be the family taking the case to court, not CCH. However, I am sure (like you are alluding to) CovCath's blessing is probably needed.

Just can't see CovCath driving this transfer. I'd think they are in a full back peddle, hoping this situation gets resolved quickly.

Who knows the original driving force.

Simply put, I think the family wants a different opportunity for their son.

Agree completely. Didn't mean to imply that CovCath is pushing for the transfer. I tend to believe that the drama will have them pull back.

I always get those confused.

Thanks for the detailed explanation of what has to occur. I'm sure that answers a lot of questions.

Short story: Sophomore year at Wyoming HS we go 8-2, Junior year we go 9-1. My parents moved me out of state to a small HS. My senior year we go 3-7. That would not have been the choice I would have made for me. Sometimes life gives you no choice. Man up, accept it, and play the best you can. I'm sure the kids at Boone will welcome him back with open arms if he goes back. I don't see where it would be that horrible for him to finish his career at Boone. I actually would respect that decision more than him trying to leave. Lemons to lemonade.

To further clarify, there is no risk to CovCath for playing him if his family were to get an injunction. No forfeits, fine or penalties, even if he is ultimately ruled ineligible. You may recall this was all clarified a few years ago when the legislature stepped hard on the KHSAA and the former commissioner 'retired'.

No, they shouldn't.
I think parents/guardians should be able to move their children freely for whatever reason they choose. Teachers, administrators, etc are allowed to change schools or school systems. When the KHSAA was founded , AGE was their main concern for eligibility, NOT where a child lived or attended school.

I disagree. Our society is way too sports crazed. Even with all the obstacles someone has to jump through, we see families and kids changing schools, moving the entire family, etc. for what ... so a kid can play high school football or basketball somewhere else? It is pathetic if you ask me. I love sports as much if not more than the next person but I think all this transferring and changing schools for what they think is a better sports situation is a joke. If you make it so anyone can change schools any time they want, there will be kids moving every time they get benched or some sweet talking coach tells them they will be a star at their school.

Do you have the specific mandate that explains the potential penalties for playing a player under injunction?

And either way the seed can still be planted privately if a school defies the KHSAA.
