Yes, here is what I believe are the facts.

 

1. KHSAA board ruled Mitchell ineligible early in the season.

 

2. Mitchell family (not HHS) went to court and a Circuit Court issued an injunction that basically said Mitchell could continue to play until it was determined in court whether he was eligible. They did not say he was eligible. They said he could continue to play until the court could hear the merits of the case and determine if he was eligible.

 

3. KHSAA appealed the injunction that allowed Mitchell to play.

 

4. Court of Appeals ruled in favor of the KHSAA and against the Mitchell family on the injunction the week prior to the state championship. This meant the KHSAA's decision that he was ineligible was in force again so HHS did not play Mitchell in the state championship game (which they won without him).

 

5. Mitchell wanted to run track also so he continued with the case in Circuit Court after the football season. After hearing the case, the Circuit Court ruled in favor of Mitchell and determined that he was eligible.

 

6. The KHSAA appealed this decision. However, the Court of Appeals eventually dismissed the appeal due to the case being deemed moot (i.e. Mitchell had graduated so there was no further need to determine his eligibility).

 

Therefore, the final ruling in the case is the decision by the Circuit Court in the spring that Mitchell was eligible.

 

If any of the above is in error, please someone who KNOWS the facts jump in and correct me. Hopefully, this is all accurate and everyone has the clear and true picture of the facts of this case.

There is a difference between setting the bar and plateauing. And yes I did say plateau, if you think you may have read incorrectly. :sssh: However plateauing still may be good enough to win a state championship. I say this because i think it is going to be difficult to surpass this group. And this group, IMO, isn't their best under Mueller.

 

There is a difference between Highlands haters and Highlands haters. I hate Highlands. I hate them for several reasons but also respect their successes. I don't hate on Highlands. I give them credit when credit is due at the same time I call them out on faults and misconducts. Once schools stop being intimidated by the image, maybe they will start hating as well and end the birds reign. But until then, they are the #1 team. 20n10 :puke:

You aren't missing it and that is probably the problem here. The Circuit Court determined Mitchell was eligible but the KHSAA apparently never agreed with that decision (hence their appeal) and then was unable to get what they likely feel is a proper review of the case due it becoming moot.

This is my fault and I apologize for it. I was under the impression that that was true, but instead the courts (which, IMO, trump the KHSAA anyway) ultimately ruled him eligible.

The Mike Mitchell Case in chronological order:

 

1. Mike transferred

2. Mike appealed to become eligible to play his senior year because when someone transfers they are automatically deemed ineligible.

3. Mike was set up with an independent party (KHSAA investigating office) to recommend to the KHSAA whether he could play or not

4. The KHSAA investigating officer recommended that Mike should be eligible

5. The reccomendation was overturned by either the Board of Controls or the Brigid Devries

6. Mike became ineligible for the 2004 football season

7. The Mitchell family went to the circuit court and got a temporary injunction

8. Highlands let him play because they agreed that if the courts say he can play then he is eligible.

9. The KHSAA appealed the temporary injunction that allowed Mitchell to play.

10. The Court of Appeals ruled in favor of the KHSAA the week of the state championship game.

11. Highlands won the State Championship and Mike did not play in the game.

12. The KHSAA stripped Highlands of 12 wins, fined Highlands $1500, and suspended Coach Dale Mueller for 2 games. Highlands was allowed to keep the championship.

13. The Mitchell family continued to fight the case in the Circuit court after the football season.

14. Mike was determined eligible by the circuit court.

15. The KHSAA appealed the decision, but was dismissed because the court determined it was a moot point because Mike had already graduated.

16. In the end Mike was eligible the whole season by the courts which are above the KHSAA.

17. The KHSAA does not want to give Highlands their 12 wins back, the $1500 fine, and is not able to give back the 2 game suspension of Coach Dale Mueller

18. The Fort Thomas Board of Education sent a letter to the Kentucky Board of Education to ask them to direct the KHSAA to rescind the sanctions. The KHSAA is an agency of the state of Kentucky. The Kentucky Board of Education which is governed by the General Assembly has the right to approve or disapprove rules and regulations set forth by the KHSAA. 19. Present time.

 

Other important points:

A. It has been said that the KHSAA has spent over $250,000 on this particular case even though the origonal KHSAA investigating officer said that Mitchell should be eligible (not a fact just a statement made by a reliable source). The KHSAA used to pay an hourly rate and within the past year have hired an inhouse council for litigation matters.

B. Since the end of the Mitchell Case the KHSAA now allows students to be able to play under a temporary injunction.

 

(Please let me know if absolutly anything is wrong about this timeline or the other important points section)

 

The reasons Highlands wants the sanctions back:

 

a. Mitchell was eligible by the Cicuit court in the final ruling

 

b. The KHSAA is not above the courts.

 

c. $1500 fine to Highlands.

 

d. The KHSAA suspended Coach Dale Mueller for 2 games.

 

e. 12 wins on the field of play. (see below)

2nd -- minor quibble, but in #10 above I would clarify "ruled in favor of the KHSAA that the temporary injunction should not have been granted -- the COA did not address the merits of the underlying case -- the week of the state championship game."
