Yes, here is what I believe are the facts.

 

1. KHSAA board ruled Mitchell ineligible early in the season.

 

2. Mitchell family (not HHS) went to court and a Circuit Court issued an injunction that basically said Mitchell could continue to play until it was determined in court whether he was eligible. They did not say he was eligible. They said he could continue to play until the court could hear the merits of the case and determine if he was eligible.

 

3. KHSAA appealed the injunction that allowed Mitchell to play.

 

4. Court of Appeals ruled in favor of the KHSAA and against the Mitchell family on the injunction the week prior to the state championship. This meant the KHSAA's decision that he was ineligible was in force again so HHS did not play Mitchell in the state championship game (which they won without him).

 

5. Mitchell wanted to run track also so he continued with the case in Circuit Court after the football season. After hearing the case, the Circuit Court ruled in favor of Mitchell and determined that he was eligible.

 

6. The KHSAA appealed this decision. However, the Court of Appeals eventually dismissed the appeal due to the case being deemed moot (i.e. Mitchell had graduated so there was no further need to determine his eligibility).

 

Therefore, the final ruling in the case is the decision by the Circuit Court in the spring that Mitchell was eligible.

 

If any of the above is in error, please someone who KNOWS the facts jump in and correct me. Hopefully, this is all accurate and everyone has the clear and true picture of the facts of this case.

And I do not have the exact date on when it happened but the Ft. Thomas board of education would not have written this letter if Mitchell was deemed ineligible.

You aren't missing it and that is probably the problem here. The Circuit Court determined Mitchell was eligible but the KHSAA apparently never agreed with that decision (hence their appeal) and then was unable to get what they likely feel is a proper review of the case due it becoming moot.

So true. This Mitchell case [and thread(s)] is kind of like watching Congress debate legislation.

I don't know, so I am asking seriously, is the burden on the KHSAA to prove that the move isn't athletically motivated, or is it on the studet-athlete? What you stated above looks very clean cut, however, I'm thinking that the Mitchell case was somewhere in the gray area.

The burden is on the athlete. When a student/athlete transfers they are automatically ineligible, merely by transferring. They have to petition the KHSAA and request a waiver to regain their eligibility.

 

If you transfer after playing one play of varsity at a school, you are automatically ineligible.

Does Highlands pay people to talk about them all year long. This is crazy to give this school this much attention. I have heard of rewarding a school for doing the right things in life. But to talk about a program for weeks all over something bad that has tainted their progam. I dont get it. :idunno:

You are full of yourself if you think they have the ability to produce a class like last years every season. Wait you are an avid Highlands fan so that answers itself. But I forsee many a bluebird fan trying to draw a comparison between last years team and teams to come. Good luck with that. And BTW, I expect the Blue Colonels to close the gap slightly from last season. Good luck in your 20umm10 campaign.

 

Last yrs class has set the bar high for many yrs to come. And that is a bad thing for opposing teams, because if incoming classes work as hard as those guys did then whats your point? And to your Blue Col comment, we hope so. :thumb:20n10
