Highlands challenging Mitchell ruling

Featured Replies

True, to that point but to the point of passing the smell test which I think honestly is the bigger question in the minds of many in the Commonwealth, it is important!

Again making it legal and making it right isn't always the same thing. You can be totally legal in doing something but in the court of public opinion, well......and I can totally understands HHS not caring one bit about the court of public opinion but.......:idunno:

Come on HHS fans someone has to know when the family moved out of Ft. Thomas!

Agree TOG. Those questions are very relevent to the TRUTH. The court case may be over, but it's very possible the truth was never identified. If HHS knows the truth to these questions - and the truth does not support this as being a valid move - then their recently filed petition is very hypocritical and arrogant. Sometimes - very unfortunately - the truth gets hidden behind legal wranglings, court filings, and backroom politics. Not saying this is the case in the Mitchell situation, as I have no personal first-hand knowledge. But someone has to . . . .

You can't handle the TRUTH!:D

You can't handle the TRUTH!:D

Oh I can handle the truth but what is the truth! :D

Just the facts jack! :D

Another question, did Boone County send money to HHS to pay for the young man schooling? Just wondering?

Funny how this young man has moved past this but the adults around this situation can't seem to do that.:lol::lol:

Thank you very much. Take a look through this thread and you will see one poster who is showing his true colors and just wont let this one go. Typical, typical, typical. :deadhorse:20n10

You avoided my question. You don't have an answer?

FWIW, I am NOT a Birds follower. As someone that is non-partial, I separate whatever the Mitchells did from what HHS did. Those are two entities with different responsibilities and should be addressed differently. I would say, too, that the motivation for each as regards the situation are different now.

Mike Mitchell is no longer a Bird. Their overall record does not affect him now. I would assume that his family has similar football loyalties now.

HHS is still HHS. They won 12 games that they can't claim, due to following a court order. I don't think that I am the only non-Bird that finds that ridiculous.

I dont have that answer to that and either do you. I understand the issue that supporters of this matter are arguing they deserve the wins because they were unlawfully taken. People on my side of the court are suggesting that if Highlands didnt put themselves in this situation, there would be nothing to discuss and the wins were not unlawfully taken because they were not rightfully earned. Others have gone as far as suggesting the Highlands has politcal or monetary influence on certain types of decisions being made...that is debatable. The reason the KHSAA didnt allow Mitchell to play is because they didnt think the transfer and address change was legit. That is my feeling as well, non legitimate transfer, no soup for you (Birds-not you directly).

Yes I am a CovCath fan: But......

Still don't understand how renting an apt, when one's home was not put up for sale, nor was there even an attempt to try to sell the home, can be called a real move, unless the family knew in advance that they would be living in Ft. Thomas for a very short time. Oh and as far as moving for the illness/injury of Mrs. Mitchell, what, there were no apartments in Florence?

Understand the housing market in Florence was as strong as could be strong during that time period unlike today, where a home can sit on the market for months, upon months, upon months.

Just wondering

1) Did the Mitchells re-register to vote in Campbell or did they still vote in Boone? Should be a matter of public record!

2) Did the Mitchells change their drivers licenses to their new address in Campbell? Should be a matter of public record!

3) Did the Mitchells re-register all their autos to Campbell? Should be a matter of public record!

4) Did the Mitchells still claim the home in Florence as their prime residence for tax purposes?

Did they do all the above?

Again just wondering, but just how long did the Mitchells live in Ft. Thomas after their son left Highlands?

I honestly think if I were the KHSAA I would find out all the answers to questions 1-4...

BTW if Mitchells were out of Ft. Thomas within six months to a year after their son graduated from HHS, then to me at least, it doesn't pass the smell test!

I believe that is exactly what the KHSAA hearing officer did. Hence the recommendation to approve the waiver for bonafide change of residence.

You could do an open records request to verify probably. If I remember correctly the answers to questions 1 and 2 were yes. Which is why it was a little surprising that the BOC voted against the recommendation of the KHSAA hearing officer at the time.

I am not sure on question 3.

I do not think question 4 is a matter of public record so I do not know the answer to that question.

Someone else might be able to confirm my answers but I believe they are accurate.

The only situation Highlands put themselves in is listening to what the court said they could do. Highlands did not do anything wrong so it doesnt matter what your feelings are. You can go on and on about false accusations of Mike Mitchell or Highlands, but there is no debate to whether Mitchell was eligible to play.

I dont have that answer to that and either do you.

I'm sincerely interested in the answer to this question.

2 questions - What position did HHS put themselves in? Can they refuse a kid the right to enroll in their school? Beyond that, they followed the KHSAA rulings, then court rulings.

By "court" I assume that you don't mean anything judiciary, correct? You mean "court" as in "side"? I just want to verify.

Others have gone as far as suggesting the Highlands has politcal or monetary influence on certain types of decisions being made...that is debatable.

As someone asked earlier, why, then does that influence not change how such a strong tax base as Fort Thomas has to 'share the wealth' with the rest of the state, as regards to school funding? Why has HHS not used this influence to become contenders for a state basketball title?

The reason the KHSAA didnt allow Mitchell to play is because they didnt think the transfer and address change was legit. That is my feeling as well, non legitimate transfer, no soup for you (Birds-not you directly).

YET...the final outcome was that he WAS determined to be eligible. So which decision of the KHSAA was the correct one? If we can question them now, why is HHS wrong for following the court order?

Also, I'm not sure that I want the KHSAA (nor the courts) making decisions based on 'feelings.' I prefer evidence every time.

... no soup for you (Birds-not you directly).

LOVE the Seinfeld reference...in addition to the willing discussion on the issue with you.

Yes, they can refuse a kid enrollment in their school.

Influence in the area of athletics is horribly different than trying to influence KY democrats that state tax base shouldn't be distributed per student. Please enlighten me as to which community of a comparable size to Ft. Thomas has more actual political representation and support living in their community. It truly shocks me that anyone would claim that Ft. Thomas doesn't have friendly support in KY state politics. Off topic, but truly amazing. As far as evidence, is it the BOC responsibility to bring evidence against the transfer's argument, or is it the tranfer's responsibility to convince the BOC. Obviously the BOC felt one way, and the courts felt another. Either way, the decision does wind up coming back to interpretation and opinion.

You mean the BOC that ultimately ruled the kid eligible? Do we go with that ruling (which means the kid was eligible all along) or another one?

BTW...who is doubting that Ft. Thomas has good political representation and connections. You (and others) are speculating on the issue...which is worth no more than feelings. Speculation is not evidence.

I am refering to the original ruling where every presiding member ruled that he was ineligable. Not one descending member out of the group that was presiding. Obviously they weren't convinced of the bonified change of address.

I don't think Highlands had to play Mitchell, right? The court said the KHSAA could not block him from playing till they decided the eligibility issue but they didn't say Highlands had to play him. So they freely chose to play him in spite of the KHSAA saying he was ineligible.

So you are saying to refuse a kid an education? Boy that would go over real well... I can't imagine the accusations that would come if Highlands refused enrollment to Mike Mitchell. I am not racist but can you imagine what would happen if a traditionally white community refused to allow a black student in the school that lived in the school district? Refusing enrollment to a student is ridiculous. Especially a public school. Why don't people look out for what is best for the kid?

As far as political distribution... Please tell me how well Ft. Thomas is represented. I agree that Ft. Thomas may have good political backing. You asked for a community that has more political representation that Ft. Thomas... Well find out about these communities and tell us. Your arguement is pointless unless you present facts. Even at that, that was the past, Mitchell is eligible and Highlands deserves their wins back.

A very wise man once told me that when people talk about your program its always a good thing because they are simply jealous and envious of what you have and what you have accomplished. Its when they quit talking about you is when you have to start to worry. Keep on talking. 20n10

Highlands could have refused to play Mitchell and therefore not give him a chance to play while recieveing a free education from Ohio University. They could have also refused to play Mike Mitchell and refused him the opportunity to make Millions of dollars by playing football for the Oakland Raiders.

Or they could play him when the courts said they could play him and not play him when the courts said he couldn't play.

People forget to ask, What was best for Mike Mitchell?
