If there were conclusive proof that TS intended to hit him or even intended to drive at him to scare him it's Kosher because Ward made the first bad decision? I don't think we would apply that logic to anything else.

 

We apply that logic to a lot of things I have seen on here. Mostly police shootings. If the girl in Burlington would have just obeyed the police order to stop, the police wouldn't have jumped on her good and shot her. If Zimmerman would have just stayed in his car, he wouldn't have killed Martin. People use this logic to make their points both for and against.

You are putting hypotheticals into the situation, not the facts. From the video, it is very difficult to tell that Stewart intentionally tried to hit him. However, for me to blame Stewart, I would need to see Ward standing by his car (not running down the track) and Stewart swerve up the track at Ward. Ward was the one who charged at Stewart much more clearly than Stewart steering his car toward Ward.

That's how I see it from the visual facts from the video. That's completely taking out any preconceived opinions of either driver. And that is removing any speculation of reving the engine or fishtailing, etc.

So the guy who jumps out of his car in a black outfit on a poorly lit track, runs down the track in traffic at a car isn't to blame? Surely everyone puts the large majority of the blame on Ward, right? Sorry the guy paid for this act with his life, but it was his fault.

 

I love ya VOR ... but seriously ... the argument surrounding Ward getting out of his car in a black outfit on a poorly lit track" crap is getting old. (By the way--I have a buddy who was there ... he says that the track is lit up better than a Christmas tree on Christmas morning--I added a youtube video that he sent to me .. that showed what his opinion of the lighting was on the track. Also--keep in mind--the video everyone keeps using to call the lighting poor .. well ... remember--the lights are focused straight on to the track--my buddy says that the original video was taken behind most of the lights--making the video look darker).

 

As far as the rest goes ... these drivers have to get out of their car (I agree .. they don't have to run close to the guy that they are arguing with). As I stated in a previous post ... it is SOP that you get out of the car and get to the infield at nearly every track I have driven at.

He intentionally swerved at Ward (he was NOT trying to hit him--but that doesn't change the fact that he pulled his famous dirt track swerve fake out move). Ward ... getting out of his car and telling Tony what is up is an accepted (and sometimes encouraged) part of dirt track racing. Just watched the full video. How ANYONE can reach any conclusion from that video other than Ward made a very fatal decision, I don't know.

Has anyone said Tony Stewart intended to hit the driver that made a mistake walking down the track? I haven't seen that. What people are saying is he may have tried to scare the kid b/c he's Tony Stewart. I really don't see how anyone thinks that isn't possible. I mean I could see someone saying I'm 95% certain he didn't do that here, but to eliminate it is hard for me. I lean towards he was trying to scare him but not hit him. I'd say I'm 75%.

The thing to me that makes it far worse and makes Stewart and his team scum is he wanted to race and they released a statement sometime in the morning after hours to reflect on what happened that said "business as usual". I think that shows true character and makes me believe even more there was a chance it wasn't totally 100% accident. I will never think he tried to hit him, but he is trash.

The bottom line for me is if dude doesn't get out of his car he is alive today.

People are asking the wrong question. They keep asking would or did Stewart intentionally hit someone? A better question would be, would Tony Stewart try to brush up with his car by a fellow hot-head driver yelling at him? Put aside the fact he did fatally hit him. I think that answer is a resounding YES with his history to support that. Obviously his intent was not to hit or kill the guy.

When your car is out of commission, they tow it to the infield or pit, which ever is closer. You don't ride along with it. I assume it's a fire risk. I've seen very few guys towed inside their cars to the infield or pit over the yrs.

While all true, Stewart and the driving culture in general assumes some fault for setting the example of how to handle oneself after a wreck.

Okay ... this may help to put some things into perspective.

I found an incar video on youtube from Canandaigua (it isn't from a sprint car--but from a modified).

My opinion--this should end the conversation regarding how dark the track is to a driver:

 

(12:58 to 13:06 puts you on the backstretch where the accident occurred).

A buddy of mine said this incident is getting brought up now. Apparently Stewart later threatened to "run over" Kenseth.
