Your having kids at your house for a sleep over with your kids. You go to sleep and they get in your Bourbon and get drunk or they find a shotgun and play with it and it goes off...You didn't give them permission to do those things but you would be liable Civilly and you'd probably get arrested.

In this example you invited minors to your house and did not supervise them. That is completely different than people partying on your property uninvited and without permission.

I'm sticking with that if the property owners did not give permission for the party, then they are not responsible for anything that occurred while it happened.

Somewhere I read that the land owners were aware these had happened in the past. If they had no idea this was an ongoing activity then they are free of ANY potential liability IMO.

 

But my point with TB&G was IF they knew these were going on, they possibly could have been found liable for doing nothing to stop or deter them.

Not even close. I would suggest you watch the unedited version. Not only is there 40 secs from when the car leaves the frame of the video until it backs back into the frame but also the car that pulls up behind where she turned onto the road was around 10 secs after she left and the guy in the car had enough time to have a conversation with a guy who walked up to his car before she was shot which also wasn't shown on the edited video but can be seen on the unedited version.

 

It's been a few days since I watched the long version but they leave the screen at the 10 second mark, the guy in the dark car pulls up, the other guy on foot walks up to his car, turns back and at I believe the 35 second mark he react buy pointing. If Brockman shot before that mark I'm sure he would have had a reaction.

One thing I didn't pick up on the first time I read the report was that the shots were actually fired through the girls drivers window. Initially I was thinking the deputy's whole body was on the hood and he fired through the windshield. After rereading it a few times, I'm not sure the deputy's whole body was on the hood. They bring up just the hand and the mirror area in the statement. Very vague but one of the questions TBD.

Actually it is a little different. In your scenario you were at the house and you have permission for the kids to be there.

 

This situation would be more like a burglar getting hurt at your house when you weren't there. You didn't give permission for him to be there nor were you home when he got hurt.

Question here as far as liability...if you (as one of her passengers) are sober, and know that she, the driver is drunk, and allow her to drive (her own vehicle) with you in it...are you liable for any actions that happen?

i have a pool. Middle of the night some teens jump my fence while I'm sleeping without my permission to swim in my pool. One drowns. I will likely be sued.
