We need to address this ASAP!

 

My undestanding was Michael Mitchell received a temporary injuction stateing he could play in all Birds games until further review or ruleing of the courts. That ruleing was issued today apparently 11/30/04. So from 11/29/04 and back he was eligible.... right?

Nope. He was ALWAYS inelligible, the injunction mearly said that he could play while it was under appeal. Which they lost. Which makes the injunction void.

I mean play with ineligiable players and all!!

All Tell, one of my biggest complaints is that the KHSAA hearing officer ruled him eligible. Two, the rule is a joke. There's no rhyme or reason to it. IF Mitchell would have moved to a school outside of the NKY area and his parents moved he would have been ruled eligible like SO many others have done. Because he moved to a different school that is in the NKY it's not legal. What's the difference??

This is HUGE loss for Highlands. In what was already going to be a tight 3A game, I will say this almost ruins the Birds' chances of winning. Unless something can happen fast to get Mitchell on the field, it looks like Boyle has 6 in a row. Of course, one player doesn't make a team, and Highlands has a lot of other weapons - but Mitchell has been almost everything to their offense recently and a big part of their dominating D. I definitely believe Highlands still has a chance, they always do, but without Mitchell, it's a small chance.

So what are we looking at here?

Can the game not even being played?

Is there a way Mitchell can appeal and win by saturday?

Can Highlands win the title and still be stripped later?

Wow! Took me an hour to get to the bottom of this thread.

 

Now, I am the usually one of the first to question the KHSAA in a lot of instances. But this for one I can't find them at fault.

 

They went by the rules and said Mitchell was ineligible. The local court gave Mitchell the injunction and then it was overturned. Don't for one second think the KHSAA had any dealings for when the ruling would be overturned.

 

I know for a fact even after the postseason they have continued a few cases in the past. So they likely would have continued this and had it come down next week Highlands might have been 0-15.

 

Now I have to get back because I'm sure there's already another 25 posts to read. Man guru, this thread is gonna keep me awake!

Then what is the purpose on the injuction and getting one? Why not just play anyways until the ruleing is made? Since its the same difference.

Guys this stuff is just wrong, the kid should have not played at all. As a Bell fan what an injustice this is. And NO Bell County is not still practicing I am sure we would get the death penalty for practicing out of season. Blaming this on Coach Smith is wrong also, if you want to blame look on the highlands sideline on Saturday he will be standing there. I think if Highlands did not have so many transfers it would not be that big of a deal but enough is enough. :irked:

If he is ruled ineligable and they have to forfeit there regular season games there is no way that Highlands can play for a state title on Saturday. I don't think we have all the info yet, but I have a feeling something big will happen one way or the other this week.

Not positive but if that was to happen then the school can be held legally liable for anything that happens to the kid and law suits.

Yes we do, and HHS plays without Mitchell as it stands. If a higher court rules in his favor in the next three days, he will suit up...
