July 22, 201214 yr Get the lawyers ready. If there is any legal ground for Penn State to stand on, I don't think they will just take the NCAA penalties without a fight. From what I have seen and read, I see two big problems with any NCAA sanctions: 1. No NCAA rules were violated. 2. If no NCAA rules were violated, then there can be no lack of institutional control. In addition, IMO there was institutional control. The President of the university knew about Sandusky right? So the proper people were notified and knew about the problem. They just made terrible decisions on how to handle the problem. Bylaw 10.1 Unethical Conduct was clearly violated...
July 22, 201214 yr I would propose no penalties this year, due to it being too late for current players to leave. Bowl Bans should start next season, IMO. Good point by Getslow that non-revenue sports will in the end suffer the most. I would also argue that any athlete at the school should be allowed to transfer and play immediately if they so choose to.

This link has the letter from Emmert to Penn State and outlines how the NCAA is approaching this situation, using Bylaw 10.1 and lack of institutional control. http://www.psu.edu/ur/2011/NCAA.pdf I still think they are in a very gray area even for the NCAA and it may come back to bite them. However, Penn State may realize that they are in a lose lose position on this and just accept the penalties the NCAA throws at them. If those penalties are unprecedented like is being mentioned, Penn State may fight back and I think they have some strong arguments they can make.

July 23, 201214 yr Could be the trigger that makes schools finally step away from the NCAA For the NCAA to do anything less than what they propose would be a public relations nightmare. Schools, regardless of how big their programs are, who propose leaving the NCAA over tough sanctions against PSU, would face the same. I don't believe this is a "draw a line in the sand" issue, if that is what you are getting at.

July 23, 201214 yr Penn State gets four year bowl ban. Vacates all wins from 1998-2011. Paterno is no longer the all time leader in wins. (Bravo NCAA) He lost 111 wins. Now sits at 298. Fined $60 Million. Lost 10 initial and 20 total scholarships per year for 4 years Players can transfer immediately.
