January 5, 201214 yr If the law treated prosecution and defense equally, then I would agree with this, but it doesn't. The penal code is replete with examples of "presumptions" that people/persons committed crimes, and therefore I see no harm in a presumption that if a person invades your home, he is there to harm you and you may kill him. If we truly want a case-by-case analysis, then eliminate the presumptions that favor police and prosecutors.:thumb:
