Jeff Ruby suing Jim Edmonds

Featured Replies

I read an article that they sell steaks....Will be interesting.

I found a menu online. No steaks, but they do have what they call Steakburgers. Maybe Steak and Shake should sue them too. :lol2:

According to their website, Edmonds restaurant is located next door to the new St. Louis Police Dept. headquarters building, so the name seems appropriate.

No way anybody would confuse these two restaurants. It looks like you could feed your family at Edmond's Precinct for less than you could feed yourself at Ruby's Precinct.

I've been in different cities with restaurants having the same name.

Not sure how this is any different.

For example, I typed in "The Burger Barn" into google. there are several across the US.

Should be a fairly simple case. Ruby should win easily as long as he has the name trademarked.

A couple of legal parallels maybe?

Several years ago a gentleman opened a barbecue restaurant in Louisville with a fire department motif (helmets, pictures, ladders, axes etc.) and called the place Firehouse Barbecue. He attempted the open other locations when he came to the attention of a chain of sandwich shops in Florida called Firehouse Subs. No similarities in food served at all. After a court action the gentleman in Louisville was forced to drop his name and re-named his place FireFresh Barbecue.

Even further back then that Ginny's Diner served a giant burger called the Sweet Daddy Burger. It was quite well known locally. At some point a restaurant opened that called itself Sweet Daddy's. It served comfort foods. The owner of Ginny's was successful in forcing the owner of the new restaurant to change the name of his place Sweet Mama's.

As I was typing this I realized that in a HUGE coincidence both Firehouse Barbecue and Sweet Daddy's were located in the same shopping center, McMahon Plaza in Hikes Point. Firehouse in a former Burger King and Sweet Daddy's in a former Sizzler.

Everybody come on over to my place for some good food off the grill. I'm calling it Ruths Chris' Mortons for the time being till I think of something better.:idunno:

Both guys are TOOL BAGS!!!!

Did some more googling. Turns out that Edmonds' original restaurant was a steakhouse but "Precinct" was not part of the name. It wasn't doing well and he changed it to a wings and beer place and started using "Precinct" in the name.

With my five minutes of legal study ie googling I think one of the factors that will be used for determining whether it is a trademark violation is if enough people are confused and think that it's Ruby's place. He did once have a steakhouse at a casino in St Louis so it is possible that people could be confused.

Ruby says all he is looking for is them to remove "Precinct" from the business name.

So if he called it "Jimmy Toolbag's Precinct" he'd be in the clear?

Or Jimmy goldglove precinct

Found a website for a place in Massachusetts called the Precinct. It serves steaks so I assume he will sue them next.

Edmonds is showing up at the restaurant in a gaudy pin stripe suit, fedora and big fat cigar. That is really what Ruby has an issue with. He's pissed too because Edmonds has a dish called the OJ Simpson Exit Burger.

Both guys are TOOL BAGS!!!!

This x1000

Ruby needs to get over himself in a big way. No one in St Louis is mistaking that place for his restaurant. Just like no one in Mass is mistaking that Precinct for Ruby"s. A quick Google search probably turns up a few dozen restaurants with Precinct in the name.

Ruby is bizarre.

Or Jimmy goldglove precinct

How about Jim "Can't Hold Griff's Jock" Precinct?

Never liked the guy and it bugs me that he ever wore a Reds uniform. He is a legend in his own mind.

Also of I had a dollar for everytime Edmonds jogged for a ball just so he could dive and catch it, I'd have enough money to buy the restaurant from him

Ruby says all he is looking for is them to remove "Precinct" from the business name.

I wonder how expensive of a change that would be for Edmonds' group. With signage, menus, advertising that is already out there.
