If Bracken county was a blue ribbon certified school would you still feel the need to move? Because if so wouldn't that be for some athletic intent, which is what the rule is designed to prevent?

 

 

I'm not familiar at all with HHS, other than their football program. BUT, in my personal experience, a better school for one's children isn't ONLY academics, or ONLY athletics, often not even a combination of both. In my experience, it's the intangibles that determine the "right" school environment for one's children. And there's no such thing as "equality" amont schools. It doesn't exist academicly, athleticly or in the intangibles. That's why I'm such a staunch supporter of school choice.

The problem is that your point (ie you should be able to transfer for athletic reasons) is 100% against what the KHSAA has in its rules. Therefore, your scenario would be a violation. As long as the other requirements are met , "intent" shouldn't be a factor.

I've said that under the scenario the wins should be reinstated, but I also think the rule should be the rule free from the exceptions(punishes everyone equally) or to allow one transfer or unlimited transfers for whatever reason. As it stands now it only creates these dog and pony shows with investigations that only serve to muddy the water when everyone knows why a kid is transfering. In the end the Mitchell's established with the courts enough to prove bona fide change, the KHSAA I suspect didn't agree because of the Mitchell's maintaining their permanant residence and ruled the way they did. From a legal point of view I see where your coming from in that if the change is bona fide, it's bona fide reguardless of the other residence.

 

I totally agree with you that under the current rule, the waters can be very, very muddy. I understand why people get frustrated, confused and angry. The no transfer at all rules would create many many problems for those folks who move throughout the state because of job changes, family issues etc. I'm more in favor of either the one free transfer/no questions asked concept or completely opening it up for unlimited transfers as long as you are enrolled in the school system on the first day of school. There is no doubt that either of those rules will create somewhat of a flight to quality which could have some major consequences. Those against the concept will claim that it will turn kids into free agents; those in favor of it will claim that it will bring some competition into operating schools and athletic programs. Both groups may be right. But if either of those rules were adopted, the big loser would be the Ru. Look how many hits he'd lose on this site! That couldn't be good for advertising revenue.

Leatherneck-can you explain the KHSAA inconsistencey with taking away Highlands wins with Mitchell playing-including the playoff semifinal win vs. Bell County and allowing them to be the state champions? If they had to forfeit the games that he played in, wouldn't that necessitate them (Highlands) being ineligible to play in the state championship game, much less win it? Yes, I am well aware he didn't play in the title tilt.

I think they should give Highlands back the wins and allow them to be state champs or if they forfeit the wins, they should have to vacate the title. One or the other. The way it is now is silly.

Well at this point, I don't believe they can futher punish Highlands for doing nothing. But from the beginning I always thought it was interesting that the KHSAA kinda went half way with the punishment. They must have thought that it was possible that they were making a bad ruling because they didn't really commit either way on the issue.

So now it's a conspiracy theory against Brigid? This is getting good now. I asked you a question in an earlier post, and you ignored it. Why won't you address the bona fide change of residence issue? You have chosen to completely ignore it, and I don't understand. Rules were broken, and that's the bottom line. Your lack of respect for the KHSAA is mind boggling to me. I am sure that you would be loving the KHSAA if they had ruled in HHS favor, and the courts went against you. A common case of completely blind loyalty here.

 

There are a few things about this post:

 

1. I do have a problem with Brigid Devries and the KHSAA because I believe the ruling on the case was wrong. As it stands now, I disagree with the way it is because the facts prove the opposite of the ruling, and there are no facts to prove otherwise.

 

2. I would be impartial on my feelings about the KHSAA if they had ruled Mitchell be eligible in the first place. I admit that the KHSAA is not in a position to be loved, it is set up to be either disliked or impartial. Kinda of like a referee, they are there to mediate and make sure people follow the rules. Referees are typically either disliked or people feel impartial to them.

 

3. Brigid Devries retired and went off into the sunset and did exactly what she wanted, which was to not return Highlands deserved wins on her watch. Therefore no matter what the result is of this, I will dislike Brigid Devries and will be completly happy she is no longer associated with the KHSAA. On the other hand, the KHSAA could return the deserved wins back to Highlands and I again would feel closer to impartial about KHSAA. I would no longer fully dislike the KHSAA. An example of this would be in the NFL with instant replay. A ref makes a wrong call and I get mad that he makes a bad call. Then the play is reviewed and the call is corrected so I am no longer mad at the refs because the call was corrected. I may not trust them again but if it is corrected then I will not have as strong of feelings against them as I did before.

I am not a part of Bluebird nation and I think you have some valid comments here. But as to the part I bolded above, what should Highlands have done? Mitchell got a court order that said he should be eligible to play. Should Highlands have ignored the court order? It was a catch 22 if there ever was one for Highlands. And that is the very reason why the KHSAA has now changed the rule in situations like this.

 

Plus, do not forget the fact that at the end of the process, Mitchell was declared eligible. So Highlands has been punished for using an eligible player who the KHSAA did not want to be eligible?

A few things here. Highlands has not lost anything and as the post said above really Highlands had no choice but to let Mike play. Where would he be if he didnt play the whole year? likely not in the NFL. Making more money than probably anyone on this site.

 

Highlands has been fighting this the whole time and you are dead wrong that Highlands was waiting for a new commissioner. Highlands has been fighting this since day 1. Just because Brigid Devries was seemingly against this, didn't mean that Highlands wasn't fighting it the whole time.

 

And of course people that don't have any connection to this issue are not going to really care, the people that do have a connection are the ones that do care.
