You don't get a DUI for that. You get a citation for open container.

^Do you know him? How do you know he wasn't a "gentle church going man"?

 

Are you not smearing him? You claimed he "go putting your hands where a cop with a weapon drawn can't see them"....You state that he did that as a fact, which it's not.

Guy I used to work with got busted for a DUI and 30 something counts of open containers for all of the empty beer cans they found in the car. Yeah he had issues.

Well if they didn't find it when they searched and found no gun, one could assume as much.

 

Took a guy to jail about a month ago for what was essentially a heroin related DUI. It wasn't until he was being processed in jail that they found more heroin on him. It was in his wallet wrapped up in a receipt, in a pocket of the wallet that couldn't be seen without completely emptying the wallets contents. What I'm getting at is checking for a gun can be done in a few minutes. Checking a person and an entire vehicle for drugs is a much more tedious process and even then things can be overlooked.

If you park your broken down car in the middle of the road ( didnt reports say car was running ?) blocking both lanes of traffic , you are ignoring the commands of a police officer with a weapon drawn my common sense tells me the guy probably wasnt just transporting the PCP . Its quite possible I could be wrong , its possible you could be too . I dont view PCP and a 6 pack with the same lens . Again thats just me.

A lot easier to clear folks of stuff that they shouldn't have on their person and let the jail be responsible for the property. Everything he had on him was placed in a brown paper bag and handed off to go with him to jail. Again not the point of my above post.

Chicago Tribune posted this below. Don't cops call in the license plate prior upon pulling up to a vehicle? Also the officer had been trained in drug recognition.

 

Crutcher had been arrested in the past. In 1995 in nearby Osage County, officers said they saw him fire a weapon out a vehicle window. Records show Crutcher was ordered to exit the vehicle for a pat-down search and began making a movement to his right ankle before an officer managed to get control of him. A .25-caliber pistol was found in his right sock, according to an affidavit.

 

Crutcher received suspended sentences after entering a no-contest plea to charges of carrying a weapon and resisting an officer, court records show.

Then, in 2002, her ex-husband's new wife filed a restraining order against her for making harassing phone calls to her, which was later rescinded. Further, she has twice been accused of using excessive force, and ultimately both complaints were found to not have enough supporting evidence.

Duece are you really going to even attempt to equate the rap sheet of the guy VS the stuff above against the cop ? Harassing phone calls which was rescinded and complaints that had no evidence VS several drug charges , a few resisting arrest , a prison sentence and the lil bit about attempting to draw a weapon from a sock on a LEO ? Really .. you better rush to Charlotte , raise the fist and join in .
