Actually, you can tail someone without turning on the headlights. But, the problem that arises is when you go to stop. Even with the headlights not turned on, the brake lights will still light...and give your position away.

Of all the things to question this one is pretty low on the list. Hell I still can't figure out how Tyrese can walk around in Georgia during the summer wearing a sock hat and sweater.
