The game WILL go on as planned. What bylaw 24 says is once tournament play starts, a team can't be removed from the bracket. The Ohio example cited earlier cannot happen in Kentucky with bylaw 24. Again, the state final game will be played!

 

In that case let the ineligable transfers begin. If this is the case then the law is absurd, no offense to Highlands or their fans' but can you imagine the stink if East Jessamine, Cov. Cath, or Bell had beat them and then found out they used an ineligable player. Either way this might be the first time in football history that a team wins a state championship with only one win, and no district wins, which wouldn't qualify them for the playoffs. Well looks like the KHSAA really didn't do themselves any favors with this one.

Sydsam, I think the rule says it won't apply in state championship competition, meaning all the playoff games, not THE state championship game. Someone said 3 pages ago KHSAA wouldn't cancel a state championship game and lose the gate. This makes no sense as a rule, but is their board's way of saying in advance they won't cancel a championship game. Coincidentally, they won't lose the gate. From the point of view of guidance to a coach or team making a decision, the message is make sure your injunction sticks through the regular season. If it does, you're in the playoffs and won't be sent home. If it's dissolved in the last week of the season you forfeited all your wins (that the player took part in) and can't go to the playoffs. No lawyer can predict the Court of Appeals docket and timeframes well enough to play this game. Certainly, no one wins under this ruling (for the reasons others have posted).

Yes I understood what it said, maybe I didn't ask the ? in the right way. It is saying if a team has an ineligable player that they will forfeit all games he played in but the team will still be allowed to play in the state game. My ? is is that right.

The KHSAA has taken the same stance all along. It is not the KHSAA who called the shots, it was the Court of Appeals, who apparently made their ruling today.

 

Here is the timeline as I understand it.

 

Mitchell transfers.

All transfers are ineligible for 1 year.

Mitchell applies for a waiver of the 1 yr clause.

KHSAA rules that the transfer was not bona fide and denies a waiver

Mitchell takes the KHSAA to court.

Court rules in favor of Mitchell

Court issues a temporary injunction allowing Mitchell to play/practice.

KHSAA files an appeal to the courts ruling.

Court of Appeals upholds the orginal KHSAA ruling and overturns the injunction.

 

Thus, legally, the KHSAA ruling of ineligibility was valid and any games Mitchell participated in are to be forfeited.

This could be a first in history.

I'm not sure the KHSAA could have done much about it. They declared the kid ineligible, then a court of law slaps an injunction on the ruling. What are they supposed to do, just give up and not pursue it?

 

True I see your point, but if they knew that nothing could be done once the state playoffs began then how could you not pursue this quicker. Since they waited this long the point is almost mute. Either way Highlands has a great team and I take nothing away from them, I just wonder how they would feel if they were on the other side of the situation.

My point exactly how can you qualify for the playoffs legally if you never won a district game. This has got to be one of the most interesting situations I have ever seen, for something like this to happen right now.

Right. If anyone affected should NOT be ticked off, it is the team that would have squeeked into the tourny. Bell Co. gave Highlands everything they could handle, and might have been able to win state. Or any other good team defeated by Highlands in the tourny.

From what I read on here in preseason the reason for the transfer was that Cov Cath only utilized Mitchell in a particular manner. He felt he could best receive a scholarship offer if he was utilized in a different way. He wasn't a bench warmer for the Colonels but my understanding is that he wasn't a star until he suited up in Bird Blue.

 

Mitchell was a leading tackler on defense for CovCath last year so I would say he would qualify as a defensive star last year. However, he almost never touched the ball on offense. He hasn't really touched the ball very much for Highlands either but Highlands has given him the ball in the big games when it's mattered the most.

I'm confused about "lousy management by the KHSAA"? Why would they not take it to Appeals? I do realize that it's bad timing on the part of the court, but an injunction by a local judge - smells of favoritism?

The KHSAA should appeal it......the same thing is going on at Pulaski County with a basketball player. I'm sure the KHSAA will appeal this local judge's decision.

You say it like the KHSAA didn't appeal til after the start of the tourny. It's just that the ruling came down now, through no fault of the KHSAA.

thats right hatz. dale did what was right for the kids. i still can't believe everyone is missing this point. all of this, the friday nite games, the pep rallys, its all for the kids. this isn't the NFL...
