If you are a gun dealer you complete a check on every sale, even at gun shows.

 

Having been audited by ATF several times they would find very quickly any gun you sold without the completed paperwork ( a 4473)

 

I have seen gun show booths that have a sign over guns for sale that state these are from my private collection. Does this get them around the background checks. I have also personally seen the dealers act as middle man brokering a deal between two customers that didn't require a background check.

Yes, if a gun is from a private collection then there is no 4473 required. I go to the show here in town every once in a while and I've seen one time when a guy had a sign like that. It was for 3 or 4 out of about 50 guns he had for sale. Sales like that are also the ones that the ATF will target during sting operations at Gun Shows, just to verify everything is legit. There is a precise paper trail on each gun sold by a licensed dealer, even if he moves some guns to his private collection he would have had to have done that in his log before selling it.

 

Private sales between people are not regulated. If I sell you a shotgun there is no process available to me to even complete a background check or get NICS approval even if I wanted to. I know several people that would feel better if that was available to do. We keep records of any gun we sell, but or trade personally...for our own protection in case something ever was to happen with a gun.

 

But yes Private sales are one loophole. I'm not sure how it could be close in a way that I personally would be agreeable with.

A few of my suggestions...

 

1. Mandatory non-negotiable jail time for crimes in which a gun is used.
   
2. Mandatory jail time for possession of a stolen gun.
   
3. Add Emergency Protective Orders to the National data base in real time.
   
4. If someone is under care due to a Mental Inquest Warrant they go into the data base immediately and must receive clearance from 2 doctors to come off of the list to be able to purchase firearms again.
   
5. Ability for individuals to get approval from the NICS system before making private sales.
   
6. Ability of individuals to verify if a gun is stolen or not prior to making a private purchase.

IE, two weekends ago when my car was broken into, if the thief has used a sledge hammer and crowbar (doubtful I know but just follow me) and broke into my safe and stole my gun, if the thief sells the gun and the purchaser has no reason to believe the gun was stolen, he/she should be innocent.

I think that's what JD would like to see put in place in the future - a method in which private sellers/buyers can check to make sure that the gun is clean before the sell. My own thoughts here, but maybe making that could become a new service that gun dealers could offer.

You see my proposals above, and I have a few more that I posted on a FB page, all said was leading to a civil conversation. But it wasn't good enough for a select few. Some just wanted to be juvenile and start name calling the people who carry. I see why those on the far right don't want to sit down and solve this, as many people are very immature and acting all bad behind a keyboard calling names. Sad people some of them.....

Unlike the-boys-who-want-to-keep-their-toys crowd, Ref has actually proposed remedies. Which raises a question: Since most of these mass muders involve troubled, angry young men, wouldn't it be wise to target this group rather than, say, Democrats or welfare recipients?
