At this point I've read about 85 different versions. It's possible I misread it.

I don't know if it is being anymore accepted...but she is repeating a story third hand, not sure every detail is going to be exact. I didn't read that the second guy was also struggling with him, but I easily could have missed it there has been so much on this.

 

Did you watch the shooting of the knife wielding suspect? Didn't it seem like there were a couple of very late shots while the guy was rolling down the little hill after being shot by the officers? Do you chalk that up to adrenaline?

Maybe, I think the fact that most people afterwards can't accurately tell how many shots they fired is indicative of being overwhelmed by the situation and adrenaline.

Google the impact of the sympathetic nervous system on use of force investigations. A lot of things that are out of your control can happen when faced with a deadly force situation.

The one thing that is bothering me about everyone accepting the officer's friend's accounts of what happened: In that account both Dorain Johnson and Michael Brown struggled with the officer with Johnson trying to get his gun. Why wasn't Johnson charged? If that's what happened why was he not charged?

She didn't say Johnson grabbed the gun, only that Brown pushed him back into the car, punched him, then tried to take his gun.

So far, there does not seem to be any factual evidence that points to the cop's story being inaccurate. The autopsies, in particular seem to contradict much of the eyewitness accounts, except for the conversation that was inadvertently caught in the background of a cell phone video - and it supports the officer's story.

 

The fact that the source of the most sensational eyewitness testimony that accused Officer Wilson of murder came from Brown's friend and possible accomplice in a robbery that took place only a few minutes earlier negates much of the testimony that implicated Wilson in a wrongful shooting.

 

Whether Brown fractured any bones in Wilson's face or not, if there are photos and/or videos showing a swollen, bruised face, then there is no way that charges should be brought against Wilson. It does not take 40 FBI agents, the Civil Rights section of the DOJ, and three or more police departments to figure that one out.

IF Brown punched Wilson while Wilson was in the car and then Brown took off running and IF Wilson then got out of his car and shot Brown who was 20 feet away(let's say he was indeed facing Wilson) and had no weapon...IF those things were presented you're saying he should not be charged simply because he was punched?

That account certainly seems more credible that Brown's friend who claimed that Wilson just reached out of his car window from a sitting position and grabbed the throat of a 6'4" 292 lb. man.

I get your point. The biggest reason I haven't really commented on what happened is because I have no clue what happened. I'll wait for the investigation to be completed before I make any decision of my own. As of right now, neither is guilty and neither is innocent.

And I don't think the additional shots mattered in that case. It appeared that he had already taken 5-6 shots to the chest. Those last 2 seemed like they came when he was rolling down the hill--well after he ceased to be a threat.

Disagree. It's not that cut and dry.
It is that cut and dried. You just don't want to see it. If Wilson reasonably claims that he that he feared for his life and acted in self-defense, no reasonable jury will convict him, assuming that the political pressure results in charges being filed.

 

A black eye and swollen face, with or without fractured bones, the size of the assailant and the presence of a second man who was at the scene of a robbery a few minutes earlier will make a compelling argument for self-defense.

 

This is not a complicated case. You are over thinking it.

If he started 35 feet away and got to 20 feet he certainly shouldn't. If he was 20 feet away and charging he almost certainly shouldn't be charged. If he was 20 feet away with his hands up and backing up saying don't shoot me he most certainly should be charged.
