Question for Guru or other officers and/or attorneys:

 

Report seems to say suggest that this girl was looking to leave the party when the officer told her to stop.

 

Will an attorney claim that the officer had no legal right to stop her unless she was showing signs of DWI? If so, will that argument fly? Did he have a right to tell her stop her car? Can he order sobriety tests for everyone at the party ?

Here is something else I have heard from apparently a sibling of the property owner. He had said that the people at the field party were trespassing. They had no permission from the owner to be there. If that is the case the officer doesn't need suspicion of possible DUI to stop any vehicle from leaving the property as they were all breaking the law by trespassing.

Chances are he had enough to stop her. The civil case will be if he had grounds to use deadly force. Ugly unfortunate situation.

To me the most likely scenario is still that she didn't know she was being asked to stop. I have a very hard time believing (no sources or info, just a hunch) that she was trying to run over the officer. DUI or no DUI in the past I can't get to her trying to run down an officer b/c she was drinking and driving again if she was.

Great question. I'm not trying to defend her actions even if it may seem so. I am just thinking she was confused and either didn't see him or he may have been at the side of the car and then stepped in front of it as she was moving. It is tragic no matter how it happened.

One of the articles quoted a passenger that said cars were stopped in front of them and she tried to pull around them. They were listening to music and didn't realize she was asked to stop. Just a guess based on this, but maybe the cars were stopped in front of her and she pulled out to pass and didn't see the officer was in front of her?

I don't think you realize how fast this stuff happens. In high stress situations like this many things happen. You have auditory exclusion, tunnel vision, loss of fine motor skills. It's really bizarre. I think only 4 rounds fired shows he wasn't trying to "kill". He's got 16 rounds in that gun and popping off all 16 is very easy to do in just a matter of seconds.

Shoot to stop the threat. This usually means in many circumstances death, and multiple shots.

 

Not to you specifically JA but in general...if a threat is perceived grave enough that an officer must draw and discharge their weapon, they are taught, just as I was in the military, to fire center mass. That means torso...chest/abdomen. And to fire until that threat is no longer a threat. It would be nice if, like in the old west movies, an officer could draw and shoot the gun out of the bad guys hand and then cart them off to jail. Unfortunately that isn't reality.

I think the evidence that'll support or debunk the civil is a combination of the video and toxicology results
