Texas father kills man trying to sexually assault daughter

Featured Replies

You would vote to put the guy in prison for manslaughter in that case?

If there is no physical evidence that an assault took place then I would have to take a long and hard look at all of the other things presented by both sides in the trail to come to a decision.

Well, I suppose I have to assume it's there. If the assailant actually assaulted a 4 year old there IS physical evidence. Whether or not it's been stated or not, if any investigator with his salt takes the case, he should be able to obtain that evidence. Perhaps Mex can confirm, but I wonder if the parents even have to give consent for an exam in this instance.

Assault is pretty broad and the article didn't say what exactly transpired so it's hard to guarantee there is physical evidence there.

Well, that's the problem here. We are arguing something that we have a very poor understanding about because the article doesn't explain much. So, my only point is that if the father is telling the truth, and he doesn't get charged with the crime, again, it's easily discerned if the child was sexually assaulted.

Somewhat similar case. Dad kills suspected perp vigilante style.

I remember that one. I wouldn't call it similar because of the time lapse.

I cannot think of one reason that guy didn't go to jail. He could have killed the officer.

OK, Mr Prosector. You just have the guy's word for it. No physical evidence. Now what? Take his word and walk away?

You didn't read what I wrote thoroughly. I was agreeing with you.

I read it and got what you were saying. I was just taking the opp to ask a lawyer how he would handle a scenario.

If what the father is saying is the truth then I am all for what he did. Karma at it's best.

I have no idea. I would think that it would be out of their hands, but that is just a guess.

Gotcha. A prosecuted would rely on physical evidence gathered by the doctor and autopsy. I would assume that their may be a chance that if the man did this, it would have gotten him sexually aroused and maybe you could find signs of that in the autopsy. As a prosecutor I show that there were no signs of that or harm to the girl. Then I would look for motive, financial perhaps.

It's obvious that some information is being withheld up to this point, since the family of the man who was killed has yet to be notified. I'm wondering if additional information--namely, the 4-year-old's hospital exam--will be released once the family has been contacted & names have been released.

Like others, if everything happened as the father claims, I have no problems with defending his daughter. If there's no evidence, though, it's really hard for me to determine what I would do as a juror.

Agreed. Head vs heart.

Honestly, if the only evidence that comes available is what we have looked at in this thread thus far, how do you vote if you're a Grand juror? Even more difficult, if you're a juror determining guilt or innocence?

Good for the dad. If he caught the guy in the act then the lawyers and doctors will find the evidence they need. In the mean time one less scum bag piece of garbage. The govt should pay the dad a percentage of what he saved us in tax dollars for the cost of having him in prison.

The penalty for sexually assaulting a child that young should be the death penalty anyway.
