I am not aware of the whole situation, but the part they showed on the news in Lexington showed her talking about some trouble her other son had gotten into. Thus she felt it would be better to move away from where all the problems stem from. If I am not mistaken they also have family in the Georgetown area and thought it would be a great place to start over.

Lets hope the BOC does the right thing and ignores the hearing officers decision. Then after this the KHSAA needs to use this transfer as the poster-situation to crack down on shady transfers.

Or lets hope the BOC does the right thing and rules what the circuit court judge says. When it comes down to it, both families had legitimate moves. There has been no wrongdoing involved to anyone's knowledge. I say let the boys play.

I don't understand why anyone would think they wouldn't be eligible by school starting. As has been said it's happening all over and has for years. Go the whole way back to the 60's at Ashland and a lot of those guys were transfers. Their Dad's got jobs at the armco plant. Some things never change and the KHSAA will never have any guts to change.

If this has happened, they have NOT been RULED eligible, they have been RECOMMENDED ELIGIBLE by the Hearing Officer. The case still goes to the Board of Control at its August meeting for a final decision according to earlier reports. The hearing officer in the Due Process cases does not make RULINGS, they make recommendations as I understand the process.

 

This, the August meeting, is where the KHSAA can run into trouble if/when the BOC overrules a retired circuit court judge. In other words, if the KHSAA is going to employ one of the greatest legal minds in the state to pass judgment on a case who is the BOC to say he/she got it wrong?

 

I don't buy the BOC being a part of a check and balance system either until all the members of the BOC are at large appointments and are not employed by any school.

No shade in this one Mr. gooch. If anything, there was more out in the open than any other I can ever recall. And if you've been paying attention, that's what some folks think is out of bounds, i.e. the comments in the paper. Perhaps too open. But legit no matter how you slice it.

Your point is very well taken. True objectivity (perceived and real) probably can't happen until that structure takes place. While there is no doubt that the current board makes every real effort to remain objective, the current setup will never overcome perception.

 

My whole purpose in posting was not the debate this specific case, but to make sure that folks were clear on what I understood the process to be. Their HO doesn't make rulings. Surely the BOC will concur with HO after debate. Seems they have been complained to by their member schools about excessive legal fees during current Commissioner's tenure, and these two cases seem certain to generate fees if declared ineligible.

 

Hopefully, with future revisions that have been announced in their procedure, the last step in the process will simply be sure to make sure the HO adhered to procedure, and the HOs decision will be accepted as the final one. That is a tough sell to many hard core folks who seem to want very restrictive rules and want to live in an older, more controlling mindset. Just isn't a good climate for restricting now at all, not in judicial nor legislative branches. Despite gnashing of teeth and complaining from some, that is the obvious handwriting on the wall. Just look at last couple of years of court cases, injunctions and legislative action which overrode the votes by the schools. Sooner or later, even if they don't like the answer, they need to listen to those who make the final decisions.

As I stated before, they did it last year... Hearing officer said the kid should be eligible, but BOC voted against his recommendation.

 

I agree about the at-large appointments. School members on the BOC often vote with selfish motives.

Here is the problem in spades. Regardless of the facts, regardless of the best interest of the individual child the BOC will always have to rule some kids ineligable - regardless of the reasoning. Why? To have some 'poster-situations' or to keep its precioius 'credibility'. Like the ancient Mayan's we sacrifice our young students atheletes at the KHSAA alter to appease the masses.

Am I missing something? My understanding is the hearing officer recommended they be ruled eligible, but the board has the final say with a vote on August 25th. Does the hearing officer's recommendation make it final?? I would think not if the board still has to vote in 30 days. May be like counting your chickens before they hatch. Or is the precedence on this that the board always votes with the hearing officer's recommendation?? If that is the case then why a vote on August 25th?? I for one am torn on the decision. I hate it for the kids, but on the other hand a line has to be drawn in the sand somewhere. It seems to me that anything goes up to now and this is one of those rules that anyone can beat or get around easily which makes it a rule of no effect and useless as it stands now. I agree if they are eligible then the pressure will be on them to win the state championship and anything less will cause quite a turmoil in Scott County.
