It may be a suggestion or best practice but I don't think it is the law that they have a bypass available. Think about it if I do a U-turn because I do not want to be stopped. How is that in reality not a direct violation of the 4th ammendment. The courts found a weird loop hole as long as it is publicized in a newspaper most people do not read it is legal. If this were really a legit practice why would it need to be advertised?
