Can I refuse to do so on the premise that when I took the job that wasn't a requirement? No, I can't. I can either get on board with the change, be fired or resign. Same thing applies here.

An attorney can refuse to represent a client. I don't believe they have to do anything they don't want to do. Perhaps an attorney who is a forum member can clear this up for us. Does a doctor have to be willing to do a sex change operation just because he or she can?

I guess my example (or my intentions with it) was more of a situation where an attorney works for a law firm and the firm decides that the attorney is now going to start representing clients in divorce cases. They refuse based on religious beliefs. Does anyone think they'd keep their job?

It's only "asking for attention" if it's a cause they don't support. To the hardcore church crowd, it's a one-way street.

 

I agree 100% Jim! And it's the ones who support her, the ones who say "it's ok for her to discriminate and the couple should just go to he next county, if not they are just seeking attention", those people saying that garbage are the ones bringing up attention first, they feel it's their way or no way, and they feel that their beliefs should trump other people's rights.

The Jewish person's right to not work Saturday is constitutionally protected if a reasonable accommodation can be made. Me not doing my job (and the Rowan County clerk not doing hers) is not constitutionally protected.

I may have told this story before.

 

Back in my days at the mental health center, we had a Jewish social worker who worked as a counselor. Company policy was Christmas Eve and Christmas off. She raised a bit of a flap, saying that she wasn't permitted to take off on Jewish "holidays". What she wanted to do was work in the office (when there would be no one else there and nothing to do), then take off on two Jewish holidays.

 

A reasonable accommodation was made. She was told that she could work in one of the residential facilities on Christmas Eve and Christmas day, then take off her two days.

It's pretty simple. One of the job responsibilities of a county clerk is to issue marriage licenses. She knew that when she accepted the job. Just because of the legal definition of marriage has changed doesn't give her the right or authority to stop doing her sworn duty. She needs to be removed and held accountable if she's breaking any laws.

A minor difference...

you are hired by a person who represents the business and fired by a person (the boss) who represents the business.

 

The County Clerk was hired (elected) by a bunch of people who probably agree with her stance, in fact, we might as well say the majority agrees with her because they helped pass a state law that prohibited the Commonwealth from recognizing anything other than traditional marriage. It was a 75% majority that passed that law.

 

Now she is being fired by whom? Not the people who elected her. The SCOTUS has no authority to fire her. Who is responsible for canning a duly elected official? Surely there is a mechanism for this. Whoever does this is not representing the will of the people to whom they answer.

 

The Will of the People does not trump the "rule of law" in our nation.

 

The rule of law has spoken and binds the elected officials to carry it out.

 

If the "will of the people" trumped the "rule of the law" desegregation would never have happened.
