Rowan County Clerk sues the Governor of Kentucky

Featured Replies

I would respectfully disagree. The courts will decide and once more the tax payers will foot the bill. Just like they are for a Clerk now.

Its not a courts issue anymore, its a legislative issue. This is all on the Governor at this point, he refuses to allow the legislator to convene to fix the law.

Then how are the other clerks able to issue any licenses?

How do you know the protesters are not public workers, did you check all their ID's? You dont know who they are.

It doesn't matter because their civil disobedience isn't being tied to their job description.

Technically they are not breaking the law either, no law exist, so the marriage licenses are invalid.

It does matter. Police officer is off duty but goes and protest, Captain sees him protesting, you think it doesnt effect his job?

Its 2015, everything you do effects your job, whether your on the clock or not.

So each person given one will have to return?

Respectfully disagree that the two scenarios are analogous

Why should people have to drive to another county?! The law is the law and if this lady can't follow the law, she should move aside and let someone do the requirements of the job.

That's like telling Rosa Parks to just call a cab if she can't find a seat on the bus.

I'm not supporting the clerk. I give her props for standing up for what she believes in but if she can't do her job, she needs to be removed from office.

That being said, they still would drive to another county if they really wanted to be married right now. Instead, they show up knowing it's not going to happen and take a camera crew with them.

I know what you're saying and I agree that Davis must do her job but desiring to be married and proving a point are two different things.

Those who want a marriage license shouldn't be inconvenienced by having to go to another county simply because the clerk is a bigot.

She has a job to do. Either do it or get the heck out of office.

It's more of an inconvenience to make a short film at the courthouse than it is to drive 10 minutes to another one.

And I agree that she should be removed from office if she can't do her job correctly.

She must be removed by recall of the voters that elected her. So I say hold a special election and recall her, however, if the people she represents choose not to recall her, then they must agree that she is performing to their satisfaction. True ?

I believe this is a States Right issue and the Federal government should not be dictating to states how they issue any particular license. I also believe that everyone who is showing up with a camera to video not being issued a license are just publicity hounds.

Have a recall vote and see what the people of Rowan County say…then force the State of Kentucky to back up or shut whatever their position is.

So there must be a recall vote to remove an elected official? It would be interesting to see how that vote turned out now.

Either do the job you were elected to or quit . There is supposed to be a separation of church and state . Isn't there ?

I've asked that question before. I know places like Casey County, if you ran in a special election by saying you would indeed grant same sex marriage licenses, you wouldn't win.

I feel like there could easily be a wave of people running for clerk who will disobey the Supreme Court ruling. And a lot of places, that would be a popular and winning opinion.
