Dont the people that are trying to get the license realized all they have to do is go to another county and get it. You can get one in any KY county, no matter where you live.

That's a really bad way to look at the situation. They could drive, or she could follow the law.

To me, one of those two options seems like the better choice.

Thats where I disagree, with the SC ruling, all marriage technically is illegal now, until states pass new laws defining marriage.

If they really wanted to get married badly, they'd go to another county.

But it's likely about more than the marriage...such as attention for the cause.

That's their prerogative. It's also her choice. Kudos to her for standing behind her beliefs, but she should be fired and replaced if she can't do her job.

Tried to copy the order. Kim Davis filed a motion to stay order. Looks like the attorney's will be burning some midnight oil these next couple of days.

I didn't realize that an elected official can't be fired.

Lady needs to get a new job .

Yep.

Here's another video of these guys; I'll let you form your own opinions:

I have that opinion too but that's the not the only one I have

Ask yourself honestly this: Why, after years of persecution, would you not take advantage of changing tides to stick it in the face of those who persecuted you?

From a sports standpoint, don't Bengals fans do this at every opportunity when they get a chance at the Steelers?

Again, be HONEST.

Like I said, I am personally all for same sex marriage. As far as this case goes, I'm not one who will say what she is doing I support. I am just thinking out loud why possibly this case is could be interesting. It's. OT that different when it comes to persecuting religous beliefs in the past...just now the shoe is on the other foot.

And yes, I get joy out of everytime the Steelers lose lol...but that is not even close to being the same thing. I know how to seperate entertainment with political and religous views.

You know darned good and well this board is full of people who care jack squat for politics/social issues. The Bengals reference was a way to pull those folks in and look at it differently from their narrow religious goggles.

And I'm sorry, but for someone like the Clerk of Rowan Co. to claim she's being discriminated against just rings hollow to me, considering the mess of 5,683,657 different Christian sects have been able to use their religion to keep others under their thumb for decades in this country. Under that thumb includes Catholics, for you NoKy and L'ville folks who are wanting to forget things.

Nothing about ultra-conservative judge David Bunning's ruling is keeping her from practicing her religion every darned night she chooses to go to church. Anybody with a brain knew this was eventually coming, from the SC or Congress or otherwise, and it's not gay people's fault, nor the federal government's fault, that she wanted to keep her head in some wacky patch of sand that tells her queers aren't entitled to the same rights as her, and that she'd never have to deal with something so atrocious when she took that oath of office.

What are the potential ramifications for her personally for refusing judge's orders?

Can she be arrested?

She could be held in contempt for failing to follow the ruling issued by Judge Bunning. My guess is that Plaintff's would need to bring that to the Judge's attention by filing a Motion for Contempt (basically saying "You told her to issue it. We went there next morning and asked it to be issued. She / her staff refused. We ask you to hold her in contempt of your ruling.") He might give them a chance to respond (short deadline), have a hearing and then issue an order. He might just issue an order. I doubt any Judge would issue a contempt order based on a YouTube video or TV report that she is not issuing orders.

My guess is she'll start issuing them before the Motion for Contempt is ripe for decision.

I'm not a legal expert so I have to ask. Can you still defy while the case is being appealed?

Judge Bunning's injunction is controlling unless / until the 6th Circuit court of appeals issues a "stay" of that order. For example, in a personal injury case, if a plaintiff is awarded $50k but the defendant appeals it, the plaintiff can still try to garnish the defendant's bank account while the case is on appeal UNLESS the defendant posts a bond (usually in the full amount of the judgment + interest).

In this instance, the 6th Circuit would look at the likelihood of success on the merits of her appeal and try to decide which is the better position during the appeal (which could take quite some time) -- injunction or no injunction. They would also look at "what harm will occur" if the injunction is / is not in place during the appeal. My guess is they would see she has VERY LITTLE likelihood of success on the merits and VERY LITTLE harm if the injunction stays in place and NOT grant the stay during the pendency of the appeal.
