That first straw poll could have been conducted before the end of the trial.

The juries I've been on, we were told not to discuss guilty or not until trial had actually ended.

I know they're not supposed to. But it happens....

Maybe so, but do you come out and tell the prosecutor that?

1) it was a mistrial either way

2) they didn't have to tell him when it was taken.

How is anyone supposed to get a fair trial in Cincinnati when even the damn city council is weighing in in his guilt. Let Deters do his job and you all do yours.
IMO, it is almost impossible to get a fair trial in a case this high profile. Everyone demands evidence be released to the public while the investigation is on going and it drives me nuts. Anyone that says they can walk into a court room as a juror on a case like this without some bias one way or the other is lying. I wish law enforcement wouldn't release anything until after a trial is over.

Article said it was taken when they first hit the deliberation phase.

The City Council, IMO is stoking the fire and hoping it will burn out. Unfortunately that won't happen. #CINCINNATIRIOTS .

Now that all the events of the trial are public knowledge, how are you supposed to get an unbiased jury for a retrial.

There are plenty of people who don't watch the news...I guess they have to find them? I'm not really sure honestly.

Only reason Deter's tried this case was to get reelected, thats why he didnt want it moved out of the area. He has been relected now, doesnt need the case, he wont go for a second trial. He knows he wont get a guilty verdict no matter how many times this case is tried.

Deters will announce tomorrow (Tuesday).

Tensing's attorney already knows what the decision is.

My guess is there will be another trial.

If not, hopefully Tensing is not involved in Law Enforcement anymore.

WCPO led the news last night that they have a reliable source that says there will be a new trial. Didn't know what the charges would be. Also clarified the informal poll that the jurors took when they first met. All 12 believed he intentially shot him. None thought it was accidental.

1. I would be surprised if it was not re-tried.

2. Tensing admitted the shot was intentional.
