Does anyone know about Hazelton the place where he is going? I'm not a penologist, but have to think he will be playing handball with the Wall Street guys. Could not imagine with a white collar offense being sent to a max like place. Any feedback Bgp'ers?

 

Multi housed high security site with a camp on the property. Secure side houses about 1,500 and the camp has 125 or so beds. Camps are usually fairly open sites with dorm style settings. I worked on a project once at a similar facility in Arizona and the high security side was high fenced razor wire, the camp side was more like an open campus…they actually did have tennis courts. Hardest part for Richie will be the boredom and monotony of doing the time, and the fact that the best pickup games are going to be on the high security side….not a lot of accountants black top pin' it I'm guessing.

If this is a just world someone will call the warden and ask if Richie is gonna play today....

I'm talking people who can't afford a high-powered attorney, or don't have family/friends to up the money. I'm talking about people of ordinary families who hire an attorney, yet the Judge decides they want to make a name for themselves and pick an issue to be "tough" on. I'm talking about politics in the judicial system and that "luck of the draw" of ones circumstances. There are a lot more poor people who sit in jail awaiting trial, then sitting in jails waiting to be taken to their eventual prison.

 

Would agree with you on this one. The system is not designed to provide any conveniences for the less advantaged. Local judges and prosecutors are worst, because when they run for office, within or outside the court system, they have to have a tough record on prosecutions. The whole judicial system not the blind scales of justice, but rather the public perception of prosecution. You can throw law enforcement into that mix as well. While it may offend some police officers, they get a lot of latitude to press their power on those that may not be able to defend themselves as well, like the poor and mentally ill. No one wants to talk about the "crimes against humanity" that occur every day by power hungry judges and prosecutors.

Richie needs to just go away. But I agree with PP92 this happens all the time. Life isn't fair nor will it ever be.

Didn't that lady that screwed the Cincinnati office employees union delay starting her sentence? Can't remember her name but it seemed like she delayed it quite a while. It does seem like it's not that out of the norm.

I could not disagree more. I feel bad for his son, but this isn't about his son. It's about the dad. And you're wrong...sentences don't get delayed every day. In fact, a lot of people with "no names" are kept in jail before they're even tried. And "no names" get sent to jail, directly to jail, and do not get to pass "go" on the way. He's already been delayed, IMO. And he was free the whole time he was waiting for trial, through his trial, and while he's been waiting on his prison assigment. If he were Susie Quick Stop Clerk who embezzeled money, she'd have been held in the county jail until the prison assignment or sent directly to a prison.

 

Just some points from my experience:

 

1. Sentences do get delayed, for a variety of reasons. For instance, prisons are already overcrowded as is, and sometimes it could be something such as having a bed open up at a given facility.

 

2. Lots of "no names" are kept in jail, but there are also lots who are released. In Texas, unless you've committed a violent rape or murder, you'll most likely get bail. Now, the amount of bail that is set may be far too high for most to pay (or post collateral for), but you'll have the opportunity to post bail.

 

3. Being free while you are awaiting trial, in most cases, is just a facet of our innocent until proven guilty justice system. It's not uncommon at all for people to be free while they await a verdict.

 

4. If it were Susie Clerk and she had a good lawyer, she'd probably have had all of the same opportunities and would be asking for the same thing. Her case might also be different because it wouldn't be such a public spectacle. If she had a good public defender even, she might get granted the same thing, or at least the opportunity to ask.

 

 

If you want a textbook example of a case where the Defendant isn't allowed to post bail, look at Aaron Hernandez's trial. Usually, it's in violent crimes or, in some cases, in instances where the Court can prove that the Defendant's freedom would interfere with the justice process by improperly influencing/intimidating witnesses, etc.

 

If you want an example of a case where the Defendant is allowed to post bail, await the trial free on bond, etc., then you are probably looking at well over 90% of the cases that go through the justice system.

The key behind delayed reporting has less to do with "name" and more to do with situation. This is non-violent, embezzlement crime tried at the Federal level….100% completely different that a state sentence. Probably more common, when the defendant asks for, that they receive a delayed reporting date than not. Like it or not, it's the way the system works. Had he been charged with a crime and tried by the State, may not have this option. Judges and prosecutors at the Federal level have less concern about "localized feedback" than at the Circuit level, so there is less concern about public outcry. He stole money from me as a state taxpayer just like every other KY resident, but he will do the time required, probably 20%. I don't see this as a special treatment case. I can name you at least 3 people I know personally, sentenced for Federal, that got a delayed report date. He's not a flight risk so report date is really irrelevant. He's going to be father to his son for the rest of his life and have to face him, I say let his kid have this one.

 

IIRC, if you are convicted of a Federal crime and sentenced, you must do 85% of that time no matter what (well, unless the conviction is overturned or something).

IMO he should report on the 18th and do his time.

He already has abused his power if they allow him to report late it will not be good for the state government and judicial system.
