Your right, the publicist that was there wasn't the one being questioned but was there to oversee the interview. You would think that if question came up that could have led to a controversial reply the publicist job was to step in and instruct Phil not to answer. But as I said in an earlier post the interviewer from A&E waited until he was alone with Phil to ask the questions that brought about the response that has everyone in an uproar. Phil was comfortable enough with the reporter that they went off on 4 wheelers together and the publicist stayed behind...that's when the controversial conversation took place.

 

I find it fascinating how many people claim to know what goes on in a journalistic interview setting. Who's to say the publicist (whether that be DC's or A&E's — I've not seen anywhere where that's been established) didn't just hear Phil say bigoted thing about gay men and think, "Aw, well, he says stuff like that all the time when filming the show," and it didn't even phase him?

 

And stop acting like the journalist is the bad guy in this situation — that he somehow isolated Phil and forced him to hang himself with his words. Phil's an educated guy, right? And a pretty opinionated one as well, it seems. It's on him if he says something regretful. Not the publicist and not the journalist.

Several years ago a new County Judge came in and fired some that did not support his election and gave those jobs to supporters...they sued and won...A LOT!!!

 

New County Clerk elected, fired several upon his taking office...they sued and won.

 

New County Attorney elected, took office fired several employees, they began to sue and it was settled out of court.

 

My point on this whole line is that I think there are repercussions that can fall back on a business or employer for simply firing someone for non work related issues. In Phil's case since there was an A&E Publicist present they may look at this as he was representing them as an employee of A&E not Duck Commander...side note on publicist, Phil and reporter went on and ATV ride and the publicist didn't go with them...that is supposedly when the question and comments came up...according to TMZ

 

Firing after not supporting someone in an election is probably seen as an impediment on the right to political association and to vote. These were also State positions.

 

If A&E fired Phil after he openly supported a political candidate, then it'd be more analogous to what you are trying to go for.

I never said the journalist was the bad guy, but it was very convenient for him that when he asked the most controversial questions he had Phil alone.

Sources very familiar with the situation tell us ... a publicist did indeed accompany Robertson to the interview -- per A&E's rigid PR policy -- and the interview took place in several locations. When the GQ reporter and Phil hopped on ATVs, the publicist didn't come along for the ride.

I never blamed anyone for what he said, I think the reporter did a good job getting a sensational quote that was sure to bring attention to their magazine and story, after all isn't that what reporters are paid to do?

I wasn't going for anything here, Jim wanted more info on another post that I had made when discussing that employers can fire someone for actions not related to their job.

Well Cracker Barrel really took a hard stance. Not sure they even had time to pull all the Duck Dynasty products before they are putting them back.

At least they learned right away they screwed up and are big enough to correct the mistake.

 

Too bad A&E hasn't learned yet.
