I'm having a hard time finding out all of the arguments in the case up for conference on the 12th. Apparently the CT Sec. of State is being sued for not properly verifiying the qualifications of Obama. I have heard through the right-wing blogsphere that this case will also be challenging the COLB as a forgery, and that the CT Sec. of State continued a fradulent action by Obama. I don't know if that is fact.

Here, let me lay out some things one post at a time for sake of discussion/argument:

 

The phrase: "Natural Born Citizen" appears only when discussing the Constitutional Requiremnts of the President of the United States.

 

Article II Section 1 Clause 4: "No Person except a natural born Citizen, or a Citizen of the United States, at the time of Adoption of theis Constitution, shall be eligible to the Office of President..."The Constitutional eligibility of the Vice President did not have to match that of the President untill the passage of the 12th Amendment in 1804:"...no person constitutionally ineligible to the office of President shall be eligible to that of Vice President of the United States."

 

Natural Born Citizen is not defined. The founding fathers Grandfathered themselves into Presidential eligibility by adding: a Citizen fo the US at time of Adoption. Just about everyone was taught in School that if you were born in the borders of the US, that made you a natural born citizen, no matter where your parents were from.

 

Jus Soli- Right of the soil or the land has generally been thought of to give Americans Natural Born Citizenship

 

Jus Sanguinis- Right of blood, gives Children of American citizens citizenship which some say is natural born, but not clear. The Supreme court has not decided a case like this, and with the Donofrio case on life support right now, doesn't look as if they will anytime soon.

I don't really see anything that makes me change my mind but wonder if the question of citizenship for others has ever been taken up before by the courts when one parent was a citizen and one was not? Add to that the jus soli interpretation and has the court ruled concerning any other person's status?

He requested and received from the State of Hawaii a copy of his birth certificate. "Certificate of Live Birth" A copy has been posted for all to see on fact check.org. Many dispute this saying it is not his Hospital Birth Certificate. There are many reasons why the original may not be handy. I myself have a "certificate of live birth" The original provided to my parents some 40plus years ago was lost or misplaced. The vital statistics burea in Hawaii has gone on record saying that the certificate they provided is "certified." and that the original is on file. There was also a birth announcement placed in a local Hawaiian newspaper. For the "tinfoil hatters" this will never be enough. They do not agree with his politics and therefore will look for any excuse to discredit him. Conspiracy theories abound and the more evidence that is produced to show that he was born in Hawaii the more they cry Foul!

Getting ahead of yourself a little ain't ya? I think he may well end up a 2timer. However, I for one, am waiting to see how he plays his cards. Obama was dealt a bad hand to be sure. However, he is playing his hand with a friendly house that has the power to make all of his dreams come true, regardless of how he plays 'em.

Actually no. Don't spread this around but I think he'll spend 16 years in the White House. If he can circumnavigated the constitution with his birth certificate I'm sure he has a plan to get around the two term limit.

I really started to get involved in researching looking around in mid-summer. Like many, I was bombarded with chain emails alleging that Sen. Obama was a Muslim, the Anti-Christ(the most insane of them all), this, that, ect. Then came the claims that he was born in Kenya. Then the Obama camp released the COLB-which has arguments for or against that I'll respond to a little later today-and then the court cases started.

 

This is not the first time that a candidate or President that has been elected, with some gray areas of Natrual Born Citizenship status. Just off the top of my head(I'll get some citations and links later on) Woodrow Wilson and Chester A. Arthur were Presidents that shared some of the same parental questions as President Elect Obama. George Romney(Mitts Father) was born in Mexico to two citizen parents, and ran for President in 1968. There have been at least 5 US Senators who were not Constitutionally eligible in terms of age at the time of thier election(VP elect Joe Biden is one, although he turned 30 years of age between the election and his swearing in as a Senator). There have been so many interesting issues brought op by these cases, that I would like the Supreme Court to decide something, so we may have some actual concrete definition of Natural Born Citizen.
