One player makes a huge difference. Look at Ricky Williams for example. The Dolphins are horrible without him. You take the star player out of the mix at any level its going to hurt. Especially on the highschool level where you have a kid like this that is as good as he is going both ways.

 

I sure thought it was the QB situation in Miami.

 

Dale has the personal to use other RB's and other SS's. He could have auditioned several players with Mitch not being there.

But the rest of the team did nothing against us.

This has been addressed before. Who's to say one of their other great backs, or another defensive player in his place, wouldn't have made those plays. We can't say, and you can't assume.

I'm not reading 15 pages of gibberish to find out if anyone said this, but I feel Mueller should just play him anyway. It's already a mess. The teams will know who won the game on the field. It's really all just for fun anyway. If I'm Boyle I don't want the win without the other team's top players on the field. This really is about having fun and doing your best. I would want my best to be against the opposing teams best. Who cares what's written in the program next season. We all know what really happened on the field. Just ask Covcath and Bell County. They went home with their tails between their legs.

Didn't the whole team know at the start that this may happen. They all knew and all the parents and all the coachs. So don't hand that out!!!!

I just had to read the post! How ludacris. Mueller can't play him. He would forever be villified, especially if they won, and ended up losing by forfeit!

The main problem I can see is that the kids from Covington Catholic and Bell County probally see that they are cheated of a trip to Louisville. The Sr's for these team will not get a chance to play at Papa John's. This was their last shot. Kind of like what happen at the Little League World Series 3 years ago with the kid from New York. This is just bad all the way around. Something should have been finalized before the season started period. I feel for all the team involved in this. (Highlands, Bell, Boyle, Covington Cath., and the rest)

I can assume in my situation because i doubt a whole lot if the other backs could have come in and been as good and as smart a player as mitchell was. He was trying to strip Robbins of the ball the whole game. I do think i would know because i was there and on the field.

I am not 100% sure on this part but I think the COA's ruling may just be procedural in nature and have nothing to do with the "facts" of the case. In other words, the Campbell Judge gave the temporary order but he never had a full hearing to either grant or deny a permanent order and I think this ruling by the COA forces either a full hearing (due process) in this case or it says the decision by the BOC stands. My point is, I don't think the COA is taking a side on the facts of the case yet, they are just setting the foundation to do so at a later date if need be.

 

I am by no means a lawyer, but a procedural ruling to me would throw this thing right back into local circuit court. I would be very surprised if there is not another hearing later this week for a permanent or another temporary injunction. It would probably be granted again and Mitchell would then be allowed to play.

 

Now the decision would need to be made by the staff to play Mitchell or not. If HHS would win with Mitchell and later again lose in the COA, the Birds would be stripped of the title. Any of this sound reasonable

This is an interesting question, and I didn't see any reply to it yet. I don't think any of the rulings is private, except possibly the hearing officer's full report and recommendations. The KHSAA publishes (or at least used to) their rulings (omitting the player's names, I think the school is named) in the magazine they send to all officials and members, and the Board of Control ruling does note the hearing officer's recommendation. I'm not an official this year so I don't have the issue with the past (someone said August?) decision. I couldn't find the publication on the KHSAA website, though it may be there and the decision should also be in the BOC minutes.

 

Once it is in court all actions by the court are generally public, including today's ruling (there are exceptional circumstances where pleadings or entire files can be sealed, but I don't think any could apply here--a Floyd county judge sealed one of these cases a year or 2 ago and got a lot of flack). I am still not clear on whether a 3 judge panel ruled today or just one judge (in which case there might be a ruling by 3 judges by Friday that could change all of this). I can't find the ruling (or any ruling of today's date) on the Court of Appeals web page, which has a searchable database of all their opinions (but may take a few days to enter). Does anyone on this thread actually have today's ruling, and if so can you scan or quote it? (Obviously, don't do that if it's sealed but you managed to get a copy). Then we'd know if it was one judge or 3, procedural or substantive...and of course that will only lead to the next round of our questions, until the next possible ruling.

This goes far beyond the game on Saturday. No one has really talked about the consequences after this game. Highlands could be struck with some major penaltys. Such as they are out of post season play for the next couple of years. Mitchell having to sit out in Saturday's game is the icing on the cake to this problem.

oneijoe, I believe HHS was listed as a defendant when the Mitchell's took it to court. I'm not disagreeing with you but what do you tell the kid when the courts ruled in his favor. The sad thing is if the KHSAA would have been consistent with this rule from day one we wouldn't be having this problem right now. The first time they granted a waiver of this rule they opened up a can of worms.

 

 

Oh, you're right. Mueller was in quite a vice on deciding what to do (not legally, but morally and ethically). He either plays him and run the risk of what has happened, or not play him and risk his stature with his players. :sssh:

 

All of this is yet another reason for the "All or None" suggestion in the transfer thread we had... (let's please not start that discussion again, though )

Then they should have scored more points than Highlands. It wasn't like Highlands was putting 70 and 80 on the board. It's just a reason for the losing teams to whine. This is a high school kid. He's the same age as everyone else. He transferred. He's not 5 years older than the other players on the team. What a joke!....These teams of high schoolers at one school were beaten by a team of high schoolers from another school. They didn't get cheated. The just got pounded by a superior team and went home losers. I would never cry about losing a game because of a transfer. A loss is a loss is a loss.
