I'm guessing Smart didn't scream because she didn't have the chance to scream. This is 180 degrees opposite of that situation.

 

Are you saying that when you walked into the room and there was no sign of conflict (which can be determined instantly) that you would still assume rape?

 

The facts are easy to see now. They would not have been easy to discern at the time. Ever hear of an instance where someone is being threatened that if they say a word that they will die? Ever think that the father might have thought someone else was in the room (that he couldn't immediately see)? You say conflict can be determined instantly...what about duress? (not confident of the spelling there)

 

The father did the right thing. He protected his daughter from what what he might have perceived as a threat. He used reasonable force. He didn't bash the kids skull in or shatter a kneecap.

 

For anyone that tries to gain entry to my house without my permission. Just so you know, I have protection, courtesy of Smith and Wesson, along with a thick cedar bat...and I am sure that I can find an iron pipe in a pinch. I will defend my house and those in it at all costs and I will be glad to accept any and all consequences of my decision to protect my family.

 

For those of you that wish to wait and determine why someone you don't know is in your house, that is your choice. I hope that no intruder ever goes your way. If so, and you make the wrong decision by deciding to ask questions first, that is something you will have to live with...or die with.

During high school, it was the kids with the "I'm a tough guy and will be the scary to everyone" father that had the most disobedient children. A father who tells their kid that they are disappointed and points out what they did wrong are much, and punishes them by taking away priviledges are much more effective. But if you want your kid hating you, and basing their life around disobeying you, please, go right ahead...

By the way, do you know much about the Smart case? The younger sister saw the intruder, but kept quiet, even after he left with Elizabeth. Do you know why? She was scared. She was afraid he would come back and take her, too. You say that Smart didn't have the chance to scream. You're right on that account. She was being threatened with a knife, though I think you meant that the kidnapping went so fast that she didn't have time to. That's not accurate. The kidnapper actually went through several rooms of the house with Elizabeth in tow.

I have 2 boys. I hope and pray I've raised them with respect and good judgement. In the event either of them show up naked in your daughter's room, you have my permission to beat them with a pipe. Then I'd hope you treated your daughter accordingly, it takes 2 to tango.

Happened in Boyd Co to a former neighbor last year. Shot a man who entered his house. The man wasn't invited. He received no punishment. FWIW, he had a teenage daughter. She wasn't directly involved but the man was walking up the stairs when he was stopped.

It looks like this thread is much like the spanking thread--pretty much divided between parents and non-parents. Once again I will say, you have no idea how nuts you will become until you are a parent. Parents have far different reactions and beliefs than non-parents as a whole. I'm not for beating anyone savagely, but if I find a naked intruder in one of my children's rooms, then I will use whatever means necessary to get that person out of my home. If I'm carrying a pipe, then that is what I would use. Moral of the story, don't sneak into people's houses (even if you are invited) and take off your clothes!

This was an issue requiring a split second decision. Thank god that the boy was not an intruder, but if he had of been, the father could have been responsible for saving the lives of his family. As it is, the boy did not receive life threatening injuries.
