The attorney may have been a tool but he wasn't the sharpest tool.:D

 

Sounds like he got them to agree to a 58% contingency fee. He must be brillant, no way I would go for that.

The family's attorney, Maurice Graham, said he informed Wal-Mart about the settlement and believed the Shanks would be allowed to keep the money.

"We assumed after three years, they [Wal-Mart] had made a decision to let Debbie Shank use this money for what it was intended to," Graham said.

 

"We assumed"......Maurice Graham is the one brain damaged....he is an idiot.

 

You know what this word means? It means it made a butt out of you and a butt out of me ( I had to substitute words).

They just had the story on the Cape Station and that is a sad for Wal Mart to do this.

 

I don't know how the people who are trying to get this money from this needy family can sleep at night.

Its more an insurance issue that Wal-mart, I work in insurance and see this all the time where health insurance providers place a lien on someones settlement because they paid for health care that was a result of a car crash. It's wrong but it happens and I'm sure most of your all's health care providers would do the same thing. No I have not affiliation to Wal-Mart other than working in the Garden Center for 2 1/2 years in college.

Excellent point. He should have had something hammered out with Walmart before the family ever agreed to a settlement.

There are a lot of bad things with Wal-mart's benefits and other things inside the company. Go into a Wal-mart and mention a union and watch how they act. I got kicked out of a Wal-mart in NKY because I was buying a Video game that every other store was sold out of and I was paying with a credit card that had Union Local 1099 on it and the cashier called the manager and they made me leave without being able to buy the game. They also told me I was no longer allowed to come in their store.

And this is exactly how it happened? So did you get something in writing stating that you werent allowed in this store again or was it just words?

The problem, especially in alot of smaller towns across Ky is that WalMart is the only store to shop...most of the mom & pop stores have folded because WalMart took their business leaving customers no other option!

 

I haven't been in a Wal Mart in about 5 years.

 

Hate the place. WalMart is everything that's wrong with America, corporate greed, putting small businesses out of business. No ethics, the whole place disgusts me...

 

So sad and yet so true!!

 

Name one that actually went out of business solely because of Wal-Mart.

 

Most small business' that falter after Wal-Mart comes to town has very little to do with Wal-Mart. In most cases customers are tired of horrible available hours of these stores 9-6 M-F 8-12 on Saturday and closed on Sunday. These stores got away with that when they were all there was prior to Wal-Mart or Lowes or whomever coming to town. It is a bad deal when you have to leave work early to get to the hardware store before it closes at 5pm so you can get the parts to fix your toilet. The second reason is that many local owned grocery stores charge either full book price or higher in some cases. I lived in one town where a local grocer complained that he had been making over 40% margin on detergent, hair spray and such type items in his store prior to Wal-Mart and Walgreens coming to town. With the average on these categories being less than 20% it didn't take his customer long to learn that he had been hosing them for years due to no competition.

 

Wal-Mart isn't perfect but it sure isn't the Devil the ACLU, UCFW and Democrats would have you believe.

I have my own stories about Wal-Mart destroying evidence, committing perjury, and abusing court rules that I will share later.

 

However, this is nothing more than insurance health care subrogation, it happens in almost every civil case in America every day, it is commonplace, and it is not a story. They are entitled to reimbursement of a portion of what they paid out.

 

The real story here is the malpractice committed by her lawyer. You NEVER, EVER settle a case like that without also settling or obtaining waiver of the subro. No lawyer, in his right mind, is going to believe that the insurer simply "forgot" about $470K in subro merely because three years of litigation passed.

 

In this case (and this is rare), I agree with AllTell that the lawyer should forfeit a portion of his fee.

As far as the injured lady goes, this is a tragic story. It would be better for Wal-Mart to look the other way. If they did they would be letting down the over 1 million people cover under their insurance plan. Each associate pays a share of their insurance for themselves and that of their family if they choose that coverage. If the insurance carrier looked the other way that would be $450,000 that would have to be made up out of everyone else's' premiums.

 

Did anyone notice that Wal-Marts insurance had already paid over $400,000 towards her medical bills. In most cases Wal-Mart Insurance does not have a maximum payout. How many of you have insurance that will pay out over $1 million if you need it? Wal-Mart's does and then some. If the accident had happened to this lady while she was at work it would have covered.

 

I have been with Wal-Mart for over 25 years, so go ahead and take your shots. I have held every level of job there is in a Wal-Mart. If you have any question about how things really are just ask, I have absolutely no reason to lie about it at this point in my career.

I'd have thrown you out too. Who you trying to fool here? You went in there know that UFCW 1099 is fighting with Walmart trying to unionize there stores. Either you violated union bylaws by shopping there or you specifically pulled out your 1099 credit card to stir up trouble. Either way, you were in the wrong.
