I'm pro choice so obviously I'd like Roe v. Wade to remain.

I'm also pro 2nd amendment.

For the SCOTUS to adhere to the Constitution and not legislate from the bench.

They all think they are adhering to the Constitution. Now they all interpret it differently but they truly believe they are.

I'd like to just maintain where we are and we will be fine.

It's usually "legislating from the bench" when one doesn't like the opinion too awfully much.

Examples of legislating from the bench?

I'm pro life and for the 2nd amendment.

Examples of legislating from the bench?

Since marriage is a state issue, many felt legalizing gay marriage nation wide rather than state to state was a cause of legislating from the bench. This was stated from some gay marriage proponents also.

Roe vs Wade is similar. Before Roe, states determined if abortion was legal, abortion was legal in New York and other liberal states before Roe. Roe took that from the states and legislated nation wide. When Roe vs. Wade is overturned, abortion will not be outlawed, it will go back to the states.

But under the above thinking then, the right to vote is a state issue and not a federal one. So do those who disagree about "legislating from the bench" dislike Court rulings on Voter Rights?

Isn't Education a State Issue? So is "Brown v Board of Education" an over reach by an activist Court? :idunno:

I'm for 2nd Amendment and I'm anti-abortion. But I don't think Roe vs. Wade will ever be overturned.

I like your views and your choice of words better than mine! I agree Roe V. Wade won't be overturned.

I think you are right. With about four-fifths of Americans wanting abortion to remain legal, at least under certain conditions, it will remain as it is. Btw, I have never known someone who is pro-abortion. Even us awful liberals don't love abortion. Just because we are pro-choice doesn't mean we are anti-life. I don't love abortion. I'm sure lawcat doesn't love abortion. But we do love a woman having the choice to make that very personal decision. Keep that decision with the woman , not a man wearing a robe. I am in favor of abortion remaining a legal option for women. I just think it has to be that way. I totally respect those who see it differently, for whatever reasons. However, as mamaw said, I don't see the law changing. Again, I've never known anyone who loves abortion.

You are correct. I am deeply in favor of a woman's right to make choices regarding her own body and the ability to have safe and legal access to doctors who are willing to perform the procedure. It's not something I would choose for myself or encourage anyone to seek. I also don't think my tax dollars should go towards abortions.

I will state though that you better make that choice within the 1st trimester as I am totally against late term or partial birth abortion.

I agree on all accounts. I would hope a decision could be made as early in the pregnancy as possible. Obviously, if the life of the mother is at risk, even after the first trimester, I am in favor of her(or family) being able to make the decision. It's just a very unpleasant topic, but an important one, I think. Bottomline, a woman should have a legal right to make decisions concerning her body and have safe and legal access to doctors. That should never be taken from her.

Though I know it will never change, Roe v Wade was legislation from the bench. It basically took rights away from the baby.

It doesn't matter which side of the issue of abortion you are on, it is a clear example of legislation from the bench.
