I think the problem started when the push came to start forcing transgenders into specific bathrooms, and laws such as the one in North Carolina started to pop up. At that point, a directive became necessary to protect the rights of transgenders. In other words, had a law meant to restrict access not appeared, there wouldn't have been a need for an executive order.

 

That was my take as well.

Our country makes laws to force certain things and behaviors always the time . It's the normal accepted way civilized societies work . To suggest transgender people had to be protected from evil restrictive bathroom nazi's is stretching the truth just a tad .

I've read the letter sent by the DoE on this issue. It is not an executive order and it does not have the force of law. The letter clarifies that transgender identity is protected from discrimination under Title IX of the Education Amendmens Act and explains how schools receiving federal funding are to comply with that law. Of course people are free to agree or disagree with the letter and its content (I personally think arguing for discrimination here is a losing proposition), but they ought to do so based on what it actually is and says and not on what they assume or wish it said.

The letter I'm reading is eight pages in total, but I don't know what you're referring to other than a few parts related to FERPA about universities needing explicit permission from students to publish their gender (and for students under 18 in secondary schools they would need parental approval).

On May 13th the Obama Adminstration released a 25 page "Guidance Document " for public schools. On page 8 it states that older children can make the decision on their own and parents need not be notified.
