If in fact her name has to be on it, I wouldn't think that a federal judge can change state law.

Just saying that if in fact her name has to be on the license, the judge can't change that...it would take the legislature. Maybe that is the case as she elected to go back to jail.

He is running behind and has to find an issue to catch up.

so i did a very little research, this all may be wrong. The county clerk has lots of duties, and ALL of the laws say "the clerk is to ________" none of the statutes say, "the clerk or the deputy clerk". The marriage license one is the same, it says "the clerk is to sign and issue..." But it does not say, "the clerk and not a deputy clerk". So it looks to me like deputies can sign anything the clerk can. And they do. So i do think the Judge was giving her an easy way out, but she refused.

Because she is an elected official, does that mean she has to be sworn in? If so, what exactly is the oath that she agreed to uphold?

Kim Davis tells judge she'd rather stay in jail than cooperate with her deputies giving marriage licenses. OK, jail it is, judge says.

 

This lady is a first class idiot, nothing more nothing else. David Bunning is giving her every chance in the world to stay out of jail. But instead she would rather force her beliefs on the deputy clerks that apparently do not have a problem issuing the licenses. Sounds toe like her and her family feel like the own Rowan County. Good luck to Mrs Davis, she's about to spend some time segregated herself.

so they can still issue without her approval? How does that work?

krs 402.100(2)(d) says a deputy clerk can sign
