I get that he asked for it. Because he saw it. But you don't think it would make you suspicious or nervous if someone were reaching all over, fidgety, searching through a glove compartment, patting pants, reaching to the side? It would. And instead of handling that the proper way, this guy was immature and not fit to be in the role he was in and it will cost him years of his life and it cost DuBose all of his.

 

It looked like he was searching around for his license. He was in the glove compartment because that's where his front license plate was.

Officer definitely fell, and it was after the shot. Meaning it could not be justified as self defense of him being on the ground close to the car.

Poor reaction by someone who belonged in a guard shack, he wet his pants and fired off a round because he started to move.

Hell to the no.

He inflamed the situation, he opened up a safety can of worms (opening door) and ultimately he took a life he had no right in even threatening, much less harming.

 

 

That was going to be my guess.

 

Just like with Sandra Bland an officer enflamed the situation and it ended poorly.

 

As you said it's amazing how interpersonal skills can have such an impact.

After watching the video again, the officer did end up at least a good 30 feet further down the road, next to the silver car that was parked on the right after the altercation.

After he fired the shot.

Everything was ok up till the officer tried to open the door.

 

The driver appeared to get scared. The cop freaked and pulled his gun. Someone's life gets taken.

More clarity.

 

From experience, video is not always an accurate representation. Two dimensions vs. three dimensions and all the moving that the camera can't keep up with.

 

Here is to hoping that body camera technology improves GREATLY so that we have better evidence in the future.

 

And I am not in any way defending the officer, I think the officer should try to work some type of "mental malfunction" plea in the case.

You can see around the 23 second mark in that video that the other police officer present for this incident is wearing a camera on her head. I would assume the officer who fired his weapon on the subject is wearing the same. This video seems a bit less shaky, although the officer doesn't fall over in this video like Officer Tensing did in the DuBose stop/shooting. It definitely seems to give you a better idea of what the officer is actually looking at, though.

In short, the guy obviously (probably) didn't have his license with him so instead of inflaming that fact the officer needed to move on to the next phase of dealing with a motorist that appears to be suspended with no license in possession. One is inflammatory (the path the officer chose) and the other can be presented in such a way to have a calming effect on the overall interaction between the officer and the motorist.

 

This is something a good Field Training Program would take care of the first few weeks/months an officer is on the street learning how to be a police officer.

Agree 100%. Once the officer asked for his license and he said he didn't have it, then asked him again with the same response should have been plenty. If he has no ID on him then run by name and DOB. OL's now come back with photo of the licensed driver so that should have been plenty of proof to ID the driver. The driver even told him to run it by name. Cit the guy if you want and move on. The Gin he had wasn't opened so there was no open container. Should have been done with and move on.

This all takes place after the initial stop has been made, after Samuel DuBose produces a closed bottle of gin from his glove compartment, and after Officer Tensing has begun questioning DuBose as to why he has not been able to produce a drivers license. Officer Tensing has made it clear that he suspects DuBose is driving on a suspended drivers license.

Officer Tensing has told DuBose to "go ahead and take your seat belt off for me", reached and grabbed the latch on the door, and started to pull the door open. DuBose says, ".but I didn't do nothing", pulls the door back shut with his left and, as seen in the still frame below, and turned the key in the ignition with his right hand to re-start his car. Officer Tensing repeats, "...go ahead and take your seat belt off", as you can hear the engine starting.

Officer Tensing orders, "Stop!" and reaches in through the driver's window at the car, presumably to try to pull DuBose's hand away from the key and/or the gear shift.

Officer Tensing has loses his balance and begins to fall backwards from the car as the car begins to roll forward. You can see a finger from Officer Tensing's left hand in the frame as he flails his left arm to try to maintain his balance.

Officer Tensing has fallen down completely and rolls away from the car. His body cam captures a shot of his face from below in this frame, as well as a glimpse of a bronze colored car parked across the street facing the opposite direction. Officer Tensing's back had been facing this car while he had his exchange with Dubose during the traffic stop.

The car on the lefthand side of the road is roughly 30 feet behind the location of Dubose's wrecked car, which is not visible in this frame.

In the remaining 28 seconds of the video, you can see as Officer Tensing runs approximately 65 paces to the crashed car, with it's engine revving irregularly with DuBose slumped dead in the drivers seat. No dragging.

The more I watch the video (and see screen by screen shots of it)......

 

I think Grand jury did the right thing in inditing the officer............

 

I dont see a jury of 12 convicting him.
