November 16, 201411 yr JD, you're off base here. If a lawsuit is filed in this case, it will be in state court, not federal court. Kentucky state law would apply. KY is a pure comparative fault state, which means that a Plaintiff's recovery is reduced by his/her percentage of fault; however, he/she is not precluded from recovery just because a jury finds Plaintiff to be 51% at fault. For example, if Ramsey was found to be 80% at fault, she could still recover for 20%. Is that why they would chose State over Federal Court? Most cases against Law Enforcement go to Federal Court...at least most that I'm aware of.

My apologies, you're right that it could be in federal court. a claim that the police used excessive force alleges a violation of the Civil Rights Act (Section 1983). 1983 claims allege a violation of one's constitutional rights, so that's why they are frequently in Federal Court.

November 16, 201411 yr First, like I'm sure all of us on here, are sorry for the loss of a life, and at such a young age. But, many of these so- called protesters are anywhere and everywhere there is an opportunity to be seen. They are very into conspiracy theories and think that the police and government are out to get everyone. They are from the former Occupy Cincinnati. Occupy started out as having good intentions, for a few days, then the strange people started to take over and it went down hill fast.

Mall Road is the primary responsibility of the Florence Police Department, not the Boone County Sheriffs Department. They should be protesting at the site of the incident or the Sheriff's Office, not on Mall Road.

I find it difficult to believe that the Boone County grand jury needed just seven hours to sift through a large amount of evidence gathered over six months. It took me about an hour just to read the transcript and then listen to the deputy's account of that fateful night.
