Gotta take up for my man John Anthony here. Going to trial can be a crapshoot. That's why prosecutors and defendants alike will take plea deals. Witnesses taking the stand. Juries can go rogue. Media attention. For those of you thinking that this would just go off without a hitch at trial' date=' why do you think that? Even people who talk on here all the time have a 14 page thread on the whole thing that's full of disagreement, so letting 12 random people decide it with all kinds of variables coming into play tells me that there's a huge range of outcomes/results. Can't speak for him, but I think John Anthony was just saying that nothing like this that goes to trial winds up ending 'pretty', it's a zero sum game that usually produces clear winners and losers.[/quote']

I listened to the podcast. I agree with Lisa Wells' main points. She was critical of the fact that the special prosecutor presented Brockman's defense to the grand jury. Wells also maintains that the deputy should have been charged with wanton endangerment for putting the three other kids in the car at risk by firing four bullets into the vehicle.

 

As I said previously, the chief aim of the investigators, sheriff's department and special prosecutor apparently was to get a tidy wrap-up to this case: "The grand jury has spoken. No questions please. Let's move on."

Fair point, but it doesn't tie in to the wanton endangerment allegation ... because it's not against the law to be intoxicated and a passenger inside a vehicle.

Still no comments on the Podcast I posted earlier? Curious to hear what some of you think. Is Lisa Wells wrong in what she states?

I don't care what's said by "your sources". Anyone can argue their side alone and be convincing. Grand jury got it right. Get over it and quit trying to lead an internet lynch mob for the Deputy.

IMO the only way there is a civil settlement is if it will cost less to pay the settlement than it would to pay lawyers to defend it.

 

If her family sues and holds out for some crazy pay day, it will go to court and at the end of the day the jury will not assign over half of the blame to the deputy. Thus leaving the family and attorneys with nothing. This will be settled for a very small amount ($150K or less) out of court settlement or nothing IMO.

For the fourth time I'll ask everyone...

 

What % is the girl to blame?

If this goes to Federal Court that's the question the jury has to answer. Then they decide on compensation.

Still way too many unanswered questions to even attempt a percentage breakdown. For instance, did any over-the-counter stuff (Red Bull, for instance) influence the deputy's actions that night? Did the post-incident blood and urine testing cover this? Medical report also noted he had traces of Xanax in his system. More information also needed here. According to information released by sheriff, doc said amount found was insignificant and "consistent with Deputy Brockman's prescribed regimen of 1 mg alprazolam (Xanax) as needed for sleep." But drug is also used for anxiety and panic disorders.

Based on your vast knowledge and all you assume about the wrong doings of the deputy, give your best estimate to a percentage of fault for each of them.

Nobody is leading anything. You need to settle down Rocket. You are taking this a little too personally to be quite honest. I am not saying the cop should have been indicted I am only saying that a respected attorney who is obviously much smarter than you or me and has been involved in dealing with Grand Juries has stated they did it ALL WRONG. You obviously cant deal with that.

If that is the case why did the Judge allow it?

Also, one of the passengers had warrant/s. Wouldn't surprise me if that individual told the driver to get the hell outta there. Just not a good situation all around.
