I think the 30% is what may get challenged in court...there have only been a couple of Tribes come out against the name and the vast majority have either said it's no big deal or no issue at all.

I was thinking the same thing, Snyder seems to be like Sterling in that he likes the fighting. I think he will make the patent office prove the 30% figure.

My point was that you didn't pick that name as a racial slur (I don't think) but some could see it that way. Do we go around changing everything in society that "May" offend some one else. Because trust me somebody some where can be found to be offended by anything.

 

I'm not defending or knocking the use of Redskins, just wondering where it could go.

Well, yea. Is anyone disputing that the Patent and Trademark Office does not have to issue a trademark to a racially offensive term and that they have the authority to decide that? And surely "the term has been used for a long time" isn't much of a defense against it being racially disparaging.

 

Trademarks also aren't permanent without updates. They have to be renewed.

You "don't think"? Good grief. What is racial about it? But really, I don't think this site abides racially disparaging usernames and if there are people on here who could make a compelling case that mine is that then I would happily change it.

 

Look, society isn't one or two people. It used to be perfectly acceptable in society to denigrate people on the basis of race. Hell, it was the law for a very long time. So, societal norms and acceptable forms of conduct change, and it isn't just because a few people whine about the status quo or try to be contrarians. I think the changing of societal norms is a slow moving and difficult process and a pretty high hurdle to clear. You all are acting like any random person can claim to be offended and demand governmental recompense, and that's not what has happened here at all.

For what it's worth also, it looks as though the logo is also protected under copyright law. The original artist created it for the team, so the team also controls the copyright, which is unaffected by this ruling.

 

Also, the office's ruling is stayed until after the appeal, so for now it is still under the protection of the trademark.

Wonder why a native American group just didn't sue the NFL and Snyder in civil court over this? The backlash is enough that the Skins will have to give in and change eventually. IMO, just depends on how much Snyder wants to pay his lawyers to fight a losing fight.

Isn't the NFL looking to possibly expand to Europe? Snyder can move them to London and call them the Redcoats.

If I was Snyder I'd make a deal with one of the Tribes to use their name (like Florida St did) and then the mascot, logo, helmets and everything could stay the same.

Warriors are not exclusive to Native Americans, though. Ask the Wounded Warrior Foundation.

 

FSU teams are still the Seminoles and Chief Osceola and Renegade their mascot. The tribe has no objections. However, politics plays in that attitude, too.

I think that would a)never be considered and b)if it was done just as a threat no one would take it seriously. The team will NEVER leave DC.
