We can all agree on this Handicapped Violation, correct?

Featured Replies

There was only one other spot available when I left. Again, spots 1 though 4 were blocked, spot 5 was taken, and spot 6 was open for that moment in time but remember we are talking about much longer than a moment in time.

Right, but this a SOAS we're talking about, not a supermarket or a Target or something. Do you really think there are very many times that in an hours time more than 2 handicapped spaces are taken at a given time?

(So I guess that wasn't my last post) :D

There are plenty of times all six spaces are taken. No kidding here and no exaggeration here.

Again, I'm no expert...perhaps CWB would be a better one to ask. However, I believe that when you submit your building plans, you have to also include parking, green space, run-off, etc. And within the parking details, you have to show which ones are handicapped designated/accessible. And yes, I believe it is federally dictated as to how many spaces (percentage-wise) MUST be handicapped.

That's all governed by the Americans with Diabilities Act (ADA). There is a required number spaces that need to be designated as handicapped and/or handicapped van accessible when anyone is building a new or renovating an existing parking lot for a commercial or public building.

SOAS has several activities where they are busy and even in what people would consider non-busy times several of the handicapped spots (if not all) are taken. I am not sure of the reason but my guess is SOAS is one of the very few gyms that still accepts Silver Sneakers meaning a lot of older folks work out there and I suppose a good percentage of them have handicapped parking rights.

Knowing the business like I know it, I would bet money someone went without a spot but again we will never know.

Am I the only one perplexed by the bolded?

I change like the seasons and honestly I feel like if the truck being parked there had became an issue then he would have moved the truck. I'm taking up for the dude who parked there because I feel he is being unfairly vilified on here for no good reason in my eyes. If he would have moved the truck if asked or if needed then what is the harm? Please explain that to me. Who was hurt by him using that available area albeit handicapped parking? Quite frankly the fact that he asked the owner if he could use that parking to load/unload is setting a good example to the kids. We can debate that all day as I feel like too much emphasis is put on what people feel is setting a good example to kids. That whole thought process is hypocrital.
So as long as the spots aren't needed right that minute it should be ok to block them? If I'm in a wheel chair how exactly do you suggest I ask the owner of the truck or the business to free up a space? Think about what it takes for a person who is in a wheel chair to get in and out of their vehicle.
So if you have a business, you HAVE to have handicap parking spaces?

If you have a parking lot that has been built or renovated since 1992 when the Americans with Disabilities Act of 1990 took effectiveness, you have to have handicap parking spaces. Renovations to a parking lot include simple asphalt sealing and/or re-painting the pavement markings.

There are a few specific exemptions that can be applied to religious organizations and private clubs, but any building of government, education, commerce or public accommodation is required to comply.

Did they say anything to the owner who allowed their spots to be occupied by non-handicapped occupants? If not, then that's on them. If no one spoke up then no one was hurt too bad in my book.

Whether the owner told them they could park there or not is irrelevant. The owner does not have the authority to allow someone to use a handicap parking spot if they don't have the proper tag. If a cop pulled into the parking lot the owner isn't getting the ticket the driver of the truck is.

I know what it is, my question was more along the lines of, if they're able enough to work out at a gym, they really don't need a handicapped parking permit.

Why are you perplexed? Handicapped people going to a gym?

I know people who have no use of their lower extremities that work their upper body all the time.

Agreed.

Are you kidding me?

I'm curious about this, and I don't know if you know the answer to it or not, but how is it determined what spots are designated for handicap use? This goes to the fact that it seems there are two spots next to the building's entrance at SOAS, but the other 4 being discussed are actually not curbside. Is there only so much distance you can go laterally, before going across to the other side? Is it a simple radius from the entrance?
