We can all agree on this Handicapped Violation, correct?

Featured Replies

I can't say for sure, but I don't think so. I think handicap parking spots have to be included in your "master plan" that is approved by zoning.

So if you have a business, you HAVE to have handicap parking spaces?

Well Birdsfan, give me your number and next time I'm moving equipment or mats for a club or school program I will call you and you can help carry the 14 sections of mats down the street with me. And we will even park in the back parking lot since I have an extra volunteer now! Seriously, Break the law?? The kids are 7-12 and they help load and unload the mats. You really need to get out and help more since you have so much time on your hands. You need to spend more time on "Entitlement" Forums then a site designs for sports with your common sence!
It's quite obvious you've never met Birdsfan and know zero about him. Since you don't know him, how would you know how giving a person he is? Oh, and I can tell you, he doesn't have a lot of time on his hands.

Look, I give you credit for volunteering your time and equipment for free, but that doesn't give you the right to break the law and sure as heck isn't a good excuse to do so. It also is setting a very bad example to the very youth you're helping. Maybe next time you might want to take a good look in the mirror before you vent on someone that has good reason to point out what's wrong with parking where you did.

Someone help me out, Ive never been to this place, do they have a loading dock or service area that deliveries and such can park to unload/load?

And let me just say this...for all of you who are on your high horse with regards to this gentleman "breaking the law"...I'm betting each and every one of you does so on a daily basis. I know I do. It's called the speed limit. And I don't care how good of a driver you are, or if you're doing 30 in a 25mph zone, or 80 in a 65...exceeding the speed limit is breaking the law. Yet we gloss right over that one like it never exists.

I'm all for having handicapped parking spots, and I don't think they should be used/abused by people who are truly lazy or just looking for a quick parking spot. However, I think you have to use some common sense sometimes too. I'm going to guess that SOS doesn't have a standard loading/unloading "zone" the way you might at some warehouse. And I'm guessing that they don't have these types of deliveries/pickups on a regular, recurring basis either, to warrant such a zone. And I think if there were people around the truck to explain the situation to someone who needed one of the handicapped spaces, I would hope they would understand the situation too. JMO.

Again, I'm no expert...perhaps CWB would be a better one to ask. However, I believe that when you submit your building plans, you have to also include parking, green space, run-off, etc. And within the parking details, you have to show which ones are handicapped designated/accessible. And yes, I believe it is federally dictated as to how many spaces (percentage-wise) MUST be handicapped.

Gotcha. I was asking because if they were removable by the owner, one might consider doing that temporarily in this instance. So that in this period of time that the trailer had to be parked there, the business could avoid being publicly ridiculed on a forum like this.

Apples to oranges and if I get caught speeding I don't whine about it, I know I was in the wrong. I take my ticket, pay it and try not to speed in the future.

I don't know, perhaps if you were handicapped and had to deal with this sort of thing on a daily basis, you might just think differently. Not sure, just a thought.

While it obviously could be physically done, I don't believe it's allowable. In fact, that could just as easily get the owner of the property in trouble with the law.

Where would you suggest he park since obviously none of the handicapped spots would be available? Once he gets his wheelchair unloaded from his van, if there is room to do that since no handicapped spots are available, are you going load the mats on his wheelchair for him?

Very true, and I try not to make snap judgments about the issue.

However, as to the speeding issue. If you're in a group of a half dozen cars going 5-10mph over the limit, but still driving safely, and not causing any other problems...but you're the one of the group that gets pulled over...I guarantee most, if not all of us on here would be complaining. We'd be complaining that they weren't enforcing the law fairly, or evenly, or that there's more important issues they should be focusing on. I know I would.

Just so I'm understanding the tone of your post... Are you implying that breaking the law by speeding is "okay," but breaking the law by parking in a handicap spot isn't?

That's what I was wondering. I didn't know it was mandated in the zoning of the property.

So, now we are equating speeding to someone with a disability being able to have appropriate access to parking. Unbelievable. I have to wonder how many know Birdsfan on here.

I'm sure many would. I've been in that situation myself before and was the one that got busted. I realized he couldn't pull all of us over and took my ticket knowing I was still breaking the law. Heck, no one is ever happy about getting a ticket, lol.
