They don't have to sit out if they come to the school as a freshman and have no prior varsity experience, but, if they played at another HS the prior year, they have to sit out, unless they relocated, which doesn't seem to be the case in this instance.

The kid has not transferred as of yet so how is the news going to break? Do you know that he is?

 

I dont think I could blame the kid if he did, if the kid wants to play football you need players that are around you to want the same. Holmes seems to fall apart every year so how is that doing him any good.

 

I don't blame him either, unfortunately, if thats what he wants, then he'll have to obide by the one year sitout rule.

So how does this ACUE money work? Clearly, Holy Cross has been a beneficiary of this, one would think.

plainspoken, I must respectfully disagree. Academic reasons are generally NOT an exception to By Law 6. For example, if a student had played varsity sports at School A but wanted to transfer to School B because he wanted to take spanish classes and School A didn't offer spanish, he would not for that reason be deemed eligible for that academic reason.

 

However, in exception 2(g) (Reassignment By Board of Education), there is some fuzzy language that states that there could be an exception to the general rule of in-eligibility if there is an assignment through KRS 158.6455 or other applicable adopted regulation. If I recall properly (and I may not), this deals with students having the right to attend another school if their school is considered to be "non-performing" or whatever the label is for those schools that the state and feds don't think are measuring up. Don't know if Holmes fits in that category or if it could be the exception that was granted. But in general, "academic reasons" is not a listed exception and is not used by the KHSAA to grant eligibility. The 3 most common ones from my recollection are: (a) a bona fide change of residence; (B) a divorce and a resulting change of residence to live with one parent due; and © a change in custody (pursuant to court order) to one parent or to a third person where the court has found that (1) the parents are unfit, or (2) the health and welfare of the student would be better served by the change in custody.

My apologies......a nonperforming school was the academic reason that I was refering to. I stated it incorrectly. I am fairly certain, as far as test scores are concerned, it would be pretty easy to become eligable for a transfer from Holmes to Holy Cross under this heading.

Here is the opening statement in the KHSAA handbook on Recruitment:

 

A pupil (domestic or foreign) at any grade level shall not be recruited to a member school of the KHSAA for the purpose of participating in athletics, including recruitment under the guise of academics.

Here is the KHSAA definition of recruiting:

 

Recruiting is defined as an act, on behalf of or for the benefit of, a school, which attempts to influence a student to transfer to a member school for the purpose of participating in athletics. A school official utilizing an intermediary including a peer, another school employee, a student, a parent or a citizen, for the purpose of recruiting a student athlete shall be in noncompliance.

As to scholarships/financial aid/etc., the rule is an athlete can not receive and aid that is not being offered to the general student body. If you are offering reduced tuition to an athlete, you must offer the same level of reduced tuition to other students in similar financial circumstances.
