From lawmakers in Kentucky. I posted this here because it specifically mentions Mike Mitchell from Highlands a couple of years ago and Highlands paid a price for this very thing.

 

 

FRANKFORT — Lawmakers faced off with Kentucky High School Athletic Association officials Tuesday, saying the KHSAA had made decisions that were not good for Kentucky's children and had acted as if the agency is above the law.

 

The issue that riled several members of the Administrative Regulation Review Subcommittee was KHSAA's policy of penalizing or threatening to punish schools that follow a circuit judge's order against a KHSAA ruling.

Can't come up with all the fancy terminology , but basically, before he graduated he was found to have done nothing wrong. He should have played in the State Championship game. Highlands should not of had to pay fines, be on probation and should not have 13 games taken away from them in the '04 season.

If the KHSAA wants to truly stop recruiting then they need to stop keeping score. WIns and losses are the number one recruiting tool. The second thing they need to do is set one flat rate on the number of dollars spent by schools on sports.

 

Because every kid and parent want the best and IMO there is nothing wrong in wanting the best. SOme schools value sports more than others.

But, by most people's standards, a player and his parents changing schools because the new school has a better sports program, is not wrong. I consider it advertising. If your programs wins a lot, and is known to be a solid program, more power to you. That is what your goal is. But, it's not illegal.

Why is it ok for parents to want their child(ren) to go to a different school for academic purposes and yet it is taboo for an athletic transfer? There are no penalties for any type of transfer except athletics (that I am aware of). Do kids that transfer to a better school for academics still get to participate in Academic Meets or do they have to sit out a year?:sssh:

Ok, alittle clarification, which I'm sure will be even more clarified plenty more times before this thread is closed.

 

Judge Reinhart issued a permanent injunction at the end of Mitchells senior year. By the time it got to the court of appeals Mike M. had already graduated. It became a moot point. The permanent injunction still stands.

I've said before that the judges are going to feel pressure to rule in favor of their local schools. I think it turns the process into a bigger circus than it already is.

Show me a judge that won't rule in favor of a local school in an election year and I'll show you a soon-to-be out-of-work judge.

Schools are usually not parties to these lawsuits, kids are. Additionally, the cases are filed in circuits, not counties. Most of the time, the "objecting" party within that case is another school, usually within the same circuit. If the circuit judge has any allegience, it could be with either school. In addition, circuit judges are only up for election every eight years, so these things are not election-year regularities.

 

I think the distrust of local courts is overblown.

Having supported a judge for election lately and knowing what I know and also echoing what you've already said. I agree. Still believe what I said prefiosuly also, disappointed in KHSAA.
