RICHMOND, Virginia (AP) -- State legislators passed a law Saturday that would require adults who French kiss a child younger than 13 to register as a sex offender.

 

 

Gov. Timothy Kaine says he plans to sign the bill that would make French-kissing minors a sex offense.

 

Those convicted of tongue-kissing a child would be guilty of a misdemeanor, punishable by up to one year in jail and a $2,500 fine. The House of Delegates passed the legislation 96-1 and the Senate 39-0.

 

The bill now heads to Gov. Timothy M. Kaine, who said he supports the legislation.

 

Delegate Riley Ingram, R-Hopewell, introduced the bill on behalf of a woman whose 10-year-old daughter was French-kissed by the 62-year-old husband of her babysitter.

One concern I would have is the age of an adult. If it is a 14 year-old and a 13 year-old, that is not going to be enforceable.

 

Is an 18-year old at a party and the 13-year old looks older and says they are older but aren't older, is that a sex offender worth offense?

I agree with you here alot of 13-year olds can pass for 18 or older if they want to bad enough. How can this be proved or disproved, by DNA or what? When one is 62 and the other 10 that is as someone else said "sick".

Is 17 years still considered a child if 18 is considered an adult? I see your point with and 18 year old and a 13 or 14 year old, but does that also mean a 17 year old dating an 18 year old the adult (18) could be considered a sex offender?:confused::confused::creepy:

I'm assuming that there must have been a recent event to create this law. Good law to have but usually there's a case that happens that usually creates new laws.

I would think that they would have to show that the violater had intent to break the law. If he kissed her, but didn't know her age b/c she misrepresented herself, I would think that he couldn't be charged. However, he would have to show that she lied to him. As a side note, this seems like this will lead to a lot of hearsay.

I've never heard an instance where a sex offender stopped at kissing before, so is this law even necessary?
