Yes, the sentence conformed to the guidelines and was based on the PSI provided. He acted within the bounds of his jurisdiction and upon the available recommendations presented in the PSI. Cannot summarily blame the judge in this case no matter how difficult the sentence may seem. I get the outrage, but all these yahoos who are calling for this judge to be recalled need to be educated. A bazillion signatures don't get him recalled. Has to be a localized ballot issue.

First, a question, this defendant who was a known drug and alcohol user to his friends, and at the same time was a gifted swimmer while in high school and his freshman year at Stanford, how did he pass the drug tests? Then localized ballot issue it should become. And the Probation Dept. had a hand in this sentence also. I would like to see a list of donors for his campaigns, if they have them. I'm horrified by this crime, this lax mental attitude about drinking causing the crime,is totally unacceptable. And so is the out of control drinking.

Friends are not questioned during PSI's and likely would not provide accurate feedback anyway. Not difficult to pass a drug test if you are casually using. Likely during the season, so he just didn't smoke during the season. Probation Department probably conducted the PSI with the information available. They do hundreds per year, so the quality is not that great. They do take feedback and a victim's statement if they will provide. I don't really know if you have been around college campuses very much but I suspect that this behavior was not so out of control that it raised any eyebrows. Binge drinking is fairly normalized for this environment. I'm not condoning or endorsing, just providing a framework for how these things come to pass. A list of donors for the judge is non-factor and the exact wrong place to place blame in this case. The system fell down here, but it does on both sides of this coin. There are times when offenders are punished more harshly than they should be as well. It is imperfect and we should work to get a better understanding of how we come to this place.
June 13, 201610 yr I have two sons and both played sports in H.S. When your friends? know what you're doing, then most likely the coach will, also. Why not drug test in the off season, if the system truly has these students welfare at heart? I volunteered A LOT at the schools, after school one afternoon when I got there, this known pot dealing loser was talking to my sons and the group I was working with, and I was livid. I literally ran his rear end off the lot and let him know I knew his name. He was never there for me to see again, maybe I was incredibly naïve about danger but I just lost it. I realize he just met some of the kids somewhere else but I didn't have to see it and my sons knew I meant it. Yes, I've been around college campuses for a couple of decades and I know this goes on. I know I can't change it but if I can get one person to not use, it is a small victory. And I don't know why all of this has become so acceptable and if it is, then no one will work against it to improve it. Yeah, I guess my decency code has become passe. But my children and grandchildren know that I talk the talk but ALSO walk the walk.
June 14, 201610 yr For everyone referring to swimming in terms of in season and off season there really is no such thing. From September through early March is short course season (also when high school and colleges compete). From late March until early August is long course season, which includes all of your junior national, senior national, Olympic trials, etc. The offseason for a top level swimmer is a few weeks in August and maybe a week or two in late March early April.
June 14, 201610 yr Didn't see it mentioned that early investigators saw some type of tweet where the scum had taken pictures of the victim's breasts and shared it on social media with some type of "who's breasts (used slang) are these?". Unfortunately the item was deleted and apparently cannot be recovered as additional charges could be brought against him if they could.
