I see the first car that woodsrider was referring to. He was higher than Stewart...

 

He was higher than the driver in front of him, who easily missed Ward... Why?

 

Ward is partially at fault for being out of his car and walking on the track... Stewart did not try to avoid him, IMO. My opinion on this still hasn't changed.

 

 

Ummm because at that point Ward was right at the nose of his own car and walking parallel to his car, not darting down the track? His own car would offer him protection there. Whether that driver saw him or not he wasn't going to run into the wrecked car and Ward wasn't moving down the track.

People that hate Stewart all see him as doing "Something" intentionally...these are the people that have referred to him with condescension and name calling in this thread.

 

People that think there "Has" to be somebody to blame for everything that happens in society...think Stewart intentionally did "Something" and it caused Ward's death.

 

Stewart Fans think he did absolutely no wrong.

 

I think it was an accident...and that accidents happen. I personally place more blame on Ward for his actions are 100% clear on the video and reserve the ability to place blame on Stewart if the evidence is clear that he intentionally tried to hit Ward. As much as everyone thinks they know what was going on in his head, no one knows if he even knew the kid was mad or even who had wrecked until he got back around to the car.

I think all these things happened. It's the intent that we will never know, and to a man, argue over.:idunno:

Based on the information and evidence I have seen, I just can't put any of the blame on Stewart. In order to put blame on him you have to make assumptions about what Stewart was thinking. So at this point, yes, pretty much it's on Ward.

Most experienced driver on the track can't keep his car under control when it's under caution? Sorry, not buying it. He hit the throttle, plain and simple. I don't think he meant yo hit him. Majority of the blame lies on Ward but TS played a role. They both have blame. More on Ward but TS also played a role.

Let me add to my previous post that I'm still not definite but that is the way I'm leaning.

Everything isn't always so black and white. I prefer to at least wait until we have all the information we will able to get.

I have a very hard time with the fact that Ward purposely got out of his car and ran down on to the racing area of the track, instead of staying in his car, until it was clear to walk down to the infield.

It's kind of like some of the discussions about police shootings and accusations of brutality. You either think the police were blameless or they had some role in it. Just like the double amputee wheelchair patient that was shot by an officer after he cornered his partner and tried to stab him with a shiny ball point pen. I understand that the officer at that point thought his partner was being stabbed by a knife and tried to protect him. However, I feel as though 2 able bodied officers should bear some of the responsibility for allowing themselves to be put in that position by a guy they knew was mentally challenged and only had one arm and one leg. In that case most police supporters had all kinds of reasons why the officers were blameless. Most neutral observers or people who are more critical of the police saw lots of fault.

 

In this case I care zero about Tony Stewart or NASCAR. Other than playing in a Fantasy NASCAR game until a few years ago I haven't kept up with it for awhile and haven't watched a race in I don't know when. I'll just say this: When assigning blame there were 3 cars that passed close to Ward while he was trying to find Stewart. All 3 cars were running about the same line on the track plus or minus a couple of feet. The first 2 came close but missed him. Stewart hit him. The position of the cars was pretty constant. That makes the big variable in the equation the position of Ward on the track. He kept moving closer and closer to the line the cars were running. Given the 5 second time span from when he cleared the front of his vehicle to when he was struck and the distance that he covered in that span I have a hard time assigning much blame to Stewart. I just find it hard to believe that he had time to realize that the kid was mad, had decided to show Stewart up, get mad himself and try to execute a plan to scare him. There just wasn't enough time.
