The 5th does indeed protect you in a courtroom from being compelled to testify against your interest, but there is no constitutional guarantee that people think highly of you.

 

As to this case, who knows? I personally always thought Kobe was guilty of poor screening rather than rape, but that seemed to be at best a 50/50 split on this board at the time.

At first blush I think most would agree. However, we say that from the comfortable position of not having a daughter who has been sexually assaulted.

 

In my mind I can possibily see how a family says "no win situation - don't want my baby girl's name dragged through the headlines - nothing can take the assault away."

Why is she trying to let it go or her family let it go, so she can probably bring it up again when he signs an NFL Contract. He dont make as much at FSU right now.

With DNA linking him, it's literally the only defense possible, whether it's true or not. There's no other believable explanation.

Can someone explain to me why the victim was still a student at FSU until last week? I just don't get that mindset by the victim and the parents. Winston allegedly rapes her, they don't pursue the case and she keeps going to school at FSU. So not only is her rapist one of the best football players in the nation this season, he's obviously Big Man on Campus at FSU so she has to see and hear about him every stinking day and she willingly went back into this environment to let him get away with rape so she could 'move on with her life'?

 

If he truly did rape her then she is the strongest woman I have ever heard of in my life. No way at all would I be able to sleep at night knowing this is what happened to my daughter and that she had to live this nightmare. No way would I not be at the next FSU football game waiting to have a conversation with Winston after the game. I'm just lost right now.
