DNA test links Jameis Winston to woman accusing him of sexual battery

Hate to be that cynic, but it still could have been consensual. This doesn't look good for Winston though. I do question why some people are indicating his silence as guilt. If accused of a criminal charge, there is the whole 5th Amendment thing.

The 5th does indeed protect you in a courtroom from being compelled to testify against your interest, but there is no constitutional guarantee that people think highly of you.

As to this case, who knows? I personally always thought Kobe was guilty of poor screening rather than rape, but that seemed to be at best a 50/50 split on this board at the time.

This makes this case more intriguing.

Don't get me started on the Kobe case. Or the Mike Tyson case.

As a parent of a daughter I'd have a hard time letting any kind of sexual assault case go involving my daughter. I don't understand that logic.

It is a shame if true that the police department did in fact try to talk her out of pressing charges. Folks should lose their jobs.

I haven't followed this closely. Has Jameis denied having sex with this girl?

I don't think the Winston camp has made any statements at all regarding whether or not he had sex with the girl. I do believe they have said they have two witnesses who can corroborate Winston's story.

That's what I'm stuck on... If her parents really believe Winston raped her, how could they possibly want to just let it go?

I hope everyone takes time and get the truth before we rush to judge the victim or Winston.

Either way this turns out someone life will change.

I don't have a problem with what they reportedly said because they were telling the truth. From what I ahve gathered all the ydid was warn her as to what could happen in a football crazy town like Tallahassee. I would prefer they warn me than act like everything would be all roses. The way it is perceived it is that they warned her in an effort to persuade her not to press charges because of who it is. I just don't see it that way. Seems like if they didn't want her to press charges they could have sabotaged all the stuff without her knowing.

The girl's family had already moved on. Now they have to go through it again and it isn't their doing.

Who is pressing the issue?

The old ESPN lawyer dude said on Mike & Mike that the key evidential factor in sexual assault cases is injury (as opposed to only DNA evidence).

At first blush I think most would agree. However, we say that from the comfortable position of not having a daughter who has been sexually assaulted.

In my mind I can possibily see how a family says "no win situation - don't want my baby girl's name dragged through the headlines - nothing can take the assault away."

It's not inconceivable .
