Doesn't matter, could still be prosecuted for consumption. Most stores will wait until you leave but by the law he could be arrested without it. In fact if a store wanted to run customers off they could charge you with eating grapes that you in turn pay for later as those are bought buy the pound and what you ate did not get weighed. But no store is going to do that!

So you guys are saying the next time I go to Speedway and grab me a fountain drink, I can be arrested if I start drinking it while in line? Good God, I've stolen a couple hundred times in my life. Who knew!

Actually it depends on the retail store. A Kmart that I managed at in KY could not prosecute customers who stole unless they walked outside, LP associates had been fired before because they stopped someone before they left the store. Now, police can come in and stop someone while they are still in the store but store associates cannot, I know it goes that way at Wal-mart as well.

So what happens next time when I'm at Speedway, and steal some sips of a speedy Freeze and fill it back up? Am I now going to be doing 5-10?

In all seriousness, people close to him say that he's homeless and has mental problems. It's funny on one hand to imagine a human raccoon living in the Valumarket, but if you imagine it's your brother or friend, the shine kinda comes of the joke.

 

I hope this leads to a suspended charge on the condition that he get the help and services he clearly needs. I don't think we need to make an example of him any more than has already been done, ie, don't do 57 whip-its and live in the Valumarket attic like a raccoon, raiding the store at night.
