Actually it depends on the retail store. A Kmart that I managed at in KY could not prosecute customers who stole unless they walked outside, LP associates had been fired before because they stopped someone before they left the store. Now, police can come in and stop someone while they are still in the store but store associates cannot, I know it goes that way at Wal-mart as well.

True but that is a company policy not what the law says. Walmart and Kmart both wait until the customer passes the last point of purchase just to make sure they can prove intent to steal. Stores, if they chose to, can stop you as soon as you conceal merchandise even though most of them don't due to company policy.

^ Additionally this is apples and oranges. Companies have limited or no stop policies to save money because the majority of their workers are not trained properly to handle investigations. In this case we are talking about a serious felony. Again, apples and oranges.
