It is pretty hard to answer one way or the other without knowing who your employer is. I am not asking that you tell us that but it definitely plays into it.

No, but I am in state government, I guess.

Sounds a little rough, but if uniforms were involved I could see where they could say you were representing the company.

I know where I worked at, I represented the company all the time, even in my sleep. No, we did not have uniforms, just clothes that we bought ourselves. I could not get a speeding ticket, could not be caught off the clock having even one sip of an adult drink, could not get caught using bad language, expressing my feelings, nothing!! It was a hard pill to swallow at first, however, I totally understand the reasons behind it and accepted it. It really tends to make you a better person at all times! PH used to tease me at home saying he was going to call my place of employment up and say that I disagreed with him LOL LOL.

Freedom of speech is also twisted so much. I wouldn't push the issue if I were him. HR might not like that.

Freedom of Speech? Where does that come into play?

Legality is irrelevant. Are you in a union? If not, you're most likely considered an "at will" employee which means they can fire you for any reason other than anything that falls under a discrimination category.

Better question is why are people tattling that a guy told an inappropriate joke?

Where in the world do you work?

I thought we were allowed to say what we want in private. I haven't read into all the details but they were off the clock away from work right? Morally or ethically is a different topic.

So you're telling me that you could don a hood and march in a Klan rally , proudly proclaim it, and when your boss finds out, you think "free speech" is going to save your job?

Your private conversations have no rights if your employer finds out about them.

If I listen to a 50 cent CD am I going to get fired too?

If I listen to a 50 cent CD am I going to get fired too?

No. But if you reenact the song you very well may.

You could. Again, a company can fire you for any reason other than your sex, race, age, or religion. No questions asked.
